Transcription

to answeare the action commenced by them against the said
shipp soe farr as the same is lyable by lawe, and
alsoe against the said Beck, and to pay what the saide
Beck shalbe condemned in with expences of suite
in case he shalbe overthrowen, and to bring forth
the said Neck in Judgement whensoever his presence
shalbe required And the said Beck obliged himself
et cetera in the same sume and to the same effect and to
save his said sureties harmeles And unles et cetera which
Caution the Judges receaved and decreed the said
shipp and the said Beck to be released from the
arrest./

Cole will give him an Account of the same
in this Court and to with drawe his action here
the said Cole did then presentlye give the said
Jennings an Account thereof under his hands
And thereupon the Judges with the consent
of the said Cole did decree the said Jennings
to be released from the Attachment of this
Court under which he nowe is without any charges
by him to be paid./

That the said James Jauncey is owner of
one 4th part of the shipp the hopewell in this
cause mentioned, and that the same was made
over unto him by the said Thomas Jauncey in his
life tyme and that he the said James Jauncey did
afterwards accept the said part and lay clayme to
the sme to his owne, and was generally reputed and
taken notice of to be an owner of one 4th part of
the said shipp, and that one 4th part of the goods
brought in the said shipp from Guiny to the Bar=
badoes was there shared for the Accompt of the said
James Jauncey and desired him to be monished to
pay one 4th part of the wages in this behalf due
The said Clements dissentinge and alleadginge that
the said James Jauncey hath not taken upon him
the administration of the goods of Thomas Jauncey
his brother deceased one of the part owners of the
shipp The hopewell in the proceedings of this
cause mentioned, but that the same hath bin and is in
due forme of lawe setled upon Thomas Marsh Esquire
and desired the said James Jauncey to be dismissed
with expences and undertooke for his appearance
