Transcription

The 10th of November 1654

Henry Hunt Thomas Barnardiston and}
William Lord imployers of the African}
frigot whereof Isaac Woodgreene is commander}
against the Madam Guardiana and her lading}

Examined upon an alleagtion on the
behalfe of the said hunt and company

Stephen Taylor of the parish of Stepney
Mariner, Gunner of the said shipp
the Affrican aged 50 yeeres or thereabouts
sworne and examined.

To the first article hee referreth himselfe to the Registrie of this Court
and saith that Captaine Woodgreene arlate at the time of the seizure
hereafter mentioned had his Commission (obtained by the producents)
aboard the Affrican frigot, which hee knoweth being one of the companie
and seeing the said Commission under a greate seale, and hearing the
same read.

To the second article hee saith that on Good friday last past the
said Isaac Woodgreene and company in the said shipp the African frigot
upon the high and open seas neere the Ile of Scio mett with surprized
and tooke a certaine ffrench shipp called the Madame Guardiana
and her lading, which hee knoweth being one of the companie as aforesaid
of the African and helping to make the said seizure. And saith that
the said Isaac Woodgreene having soe made the said seizure, was
for provision of victualls and other occasions constrained to goe with
and carry the said Prize to Smirna, where being arived, the ffrench
Consull there tooke away the Captaine and companie of the said prize
the Madam Guardiana, and disposed them into other ffrench vessells
and sent them away for ffrance, and would not permitt the said
Captaine Woodgreene to detain any of them to bringe them hence
for England, although hee used all diligence and earnestly desired
to have some of them to bring them for England, all which hee knoweth
being present and privie to the same, And otherwise hee cannot depose.

To the third article hee saith and deposeth that after the said seizure
this deponent heard some of the ffrench companie of the said prize
say and confesse that the said shipp and goods belonged to Marseilla and
to ffrenchmen there, and that shee came thence. And otherwise hee
cannot depose.

Thomas Clarke of Gravesend in the County of
kent Mariner, masters mate of the said shipp the
Affrican frigot, aged 38 yeares or thereabouts
sworne and examined.

To the first article of the said allegation hee saith and depposeth that
the time arlate and when Captaine Isaac Woodgreene in the said shipp
the African frigot made seizure of the prize the Madame Guardiana,
hee the said Wood greene had a Commission under the greate seale of this
Court
