Transcription

Court, which was obtained by the arlate henry hunt, Thomas Barnardiston
and William Love for the equipping, fitting and setting out of the said
shipp the Affrican frigot to sea upon a war like imployment for the seizing
and taking the shipps and goods of the States of the United Netherland
Provinces and their subiects, and of the ffrench kinge and his subiects,
and saith the said shipp was sett out and Imployed accordingly, and
the said Isaac Woodgreene went in the said shipp with the said Commission
as commander of her, which hee knoweth being masters mate of that
said shipp the Affrican, and seeing the said Commission and hearing
the same read. And otherwise hee cannot depose.

To the second article hee saith and deposeth that on or about
Good friday last past, the said Isaac Woodgreene in the said shipp
the Affrican on the high and open seas neere the Ile of Scio mett
with and by vertue of the said Commission seized and tooke a certaine
ffrench shipp called the Madame Guardiana (which was manned with
ffrench and Provencalls, subiects of the ffrench kinge) and alsoe her
lading; which hee knoweth being present and helping to make the
said seizure, And saith that after the said seizure soe made the
said Captaine Woodgreene for provision of victuall and other
occasions was necessitated to carry the said prize the Madame
Guardiana to Smyrna, where her ffrench commander and company
got ashore, and the said Captaine Woodgreene could not be permitted
to bring any of them for England, all which hee knoweth, being
present and taking notice of the premisses. And otherwise hee
cannot depose.

To the third article hee saith that after the said seizure
this deponent heard some of the ffrench Company
of the said shipp the Madame Guardiana say and acknowedge that
shee and her lading came from Marseille and were belonging to
ffrench men, subiects of the ffrench kinge. And otherwise hee
cannot depose.

John Sandys of London Marchant aged 25 yeares or
thereabouts, sworne and examined.

To the first article of the said allegation hee saith and deposeth that
within the time arlate the producents henry hunt, Thomas
Barnardiston and William Love had and obtained a Commission
under the greate seale of this Court for the equipping, fitting and
setting out of the said shipp the African to sea upon a warlike
imployment to seize the shipps and goods of the States of the
United Netherlands and of their subiects and of the ffrench kinge
and his subiects, and that the said shipp was accordingly sett out
and imployed, and the arlate Isaac Woodgreene went out Commander
