from Newfound land with a ffrench vessell laden with fish for
honfleur, was met with and taken by one of the frigots
of this Commonwealth and brought into Plimouth, and his shipp and
goods made prize, and the said ffish soe laden aboard this deponents
vessell, was of the fish that came out of the said french vessell
whereof the said Ozan or Oze being dispossesed, hee imbarqued himselfe
in this deponents said shipp for honfleur and was there by the said
Mr Martens order to receive the said fish. But saith
hee cannot depose of any expressions or declarations of the said Ozan
or Oze purporting the said lading to be his, or laden aboard the
SEaventure for his accompt, but at the Ile of Wight finding [?fault]
with this deponent as if hee had not hastened his voyage, hee said,
that if the fish were spoiled by this deponents not going to sea, hee
would make this deponent pay for it, and on the day of the seizure
and a little before the seizure happened, being within a matter of
two houres saile of honfleur, hee told this deponent that hee
should dine in honfleur with hin the said Oan
or Oze, hee living there. And otherwise hee cannot depose,
saving that after this deponent was laden at Plimouth and the
winde comming faire, and this deponent preparing to saile, the
said Mr Marten willed him to make fast againe, and told him hee
would pay for his demourage, till the next port time, which this deponent accordingly did
and staid about foure dayes till the post came from London,
and for such stay the said Mr Marten gave him fourtie shillings
and this deponent conceiveth that the said delay was caused by the
said Mr Marten that hee might have answer from London of
the said Ozan or Oze his bills being accepted at London for
payment for the said fish, before the same departed from Plimouth
To the fifth hee saitth that besides the said Banck fish
amounting to about 8000 (although his bills of lading mentioned
but 6000) there were six barrells and a hogshead of raw hides, and
twenty hides that were not in caskes, and twelve rolls of [?sete]
leather, as by the outside of the said roles appeared, which hides
and leather were brought by the said Monsieur Ozan or
Oze in the night time from the towne, aboard the shipp then being
in the sound of Plimouth, and neither Mr Marten nor his man
came with him, wheread Mr Martens man was present at the
lading of the ffish, nor did any other person then the said Monsieur
Ozan or Oze appeare to this deponent to be lader of the said
hides and leather, only another stranger came alonge with him
in the boate and retourned for Plimouth.
To the 6th hee referreth himselfe to his foregoeing deposition and cannot
otherwise depose.
To the 7th hee saith hee signed three bills (all of one tenor) for the
said fish, two whereof hee left with Mr marten, and carried the other
to sea, which was taken by the Ostender, but hee beleeveth Mr Marten
hath his two still, And otherwise hee cannot depose saving as aforesaid
