made but for the more certayntie referreth himselfe to the sayd decree and
order and further cannot answere./

To the 4th Interrogatorie hee saith hee this deponent is Master of the sayd shipp the Elizabeth
and had in her at her seizure one hundred and six cakes of Rozen and sixe hogsheads
of turpentine and other goods which are discharged by order of the Court of
Admiralty Interrogate and this rendent hopeth to receive them And further
hee cannot answere otherwise then negatively./

Examined upon the sayd allegation

John Bleker of fflushing in Zealand Mariner Boatswaine
of the shipp the Elizabeth of fflushing aged fourty seaven yeares or
thereabouts a witnesse sworne and examined saith and deposeth as
followeth

To the sayd allegation hee saith that hee this deponent was boatswaine of
the shipp Elizabeth of fflushing allegate during the voyage now controverted and
soe still is and hath heard his contest John Noose (the master of her during
the same voyage) saye that the freighters thereof for the sayd voyage did agree
with him the sayd John Noose that the sayd shipp should staye noe longer than
thirty dayes in takeing in and unladeing of her ladeing that voyage and that they
the sayd ffreighters were to allowe him twenty guilders per day for
demorage for every day that the sayd shipp was stayed in takeing in and
unladeing her sayd ladeing above the sayd thirty dayes And this deponent
being boatswaine of her well knoweth that the sayd shipp the Elizabeth did
lye at Bayon in ffrance for receiving in her ladeing now controverted from
the 25th of August last past to the 28th day of September last past soe
that according to the sayd agreement of the freighters with the Master John
Noose the whole tyme for ladeing and unladeing were expired before she
departed from Bayon And saith that after shee had taken in her full
ladeing the sayd shipp departed from Bayon intending to carrye the same to
haver de Grace in ffrance but in her Course thitherwards was mett with and
taken by the Tyger ffrigott in the omediate service of this Commonwealth
and by the Commander thereof sent to this Port of London whither shee
was brought and hath continued ever since the 7th of October last to the 8th
of december instant, upon whch day and not before (as the sayd John
Noose told this deponent) the Commissioners of theis Commonwealth for prize
goods did paye the sayd John Noose the freight due to him for the goods now
controverted, and this deponent knoweth that soone after the sayd 8th of decem
ber the sayd John Noose did pay unto this deponent the wages due to whim which
hee sayd was part of the freight money paid him by the sayd Commissioners
And saith that the sayd shipp Eizabeth did lye here at this port of London
and had continually wayters on board her by the space of forty dayes or
thereabouts before shee was cleerely unaden of the goods seized in her And
further hee cannot depose saving hee beleeveth the Commonwealth
