freighters were to allowe and paye unto him this deponent for demorage twenty
guilders a day for every day that the sayd vessell should be stayed above the sayd
thirty dayes in receiaving in and delivery out of her sayd ladeing, And hee alsoe saith
that hee well knoweth being Master as aforesayd that the sayd Vessell the Elizabeth
of fflushing did notwithstanding the sayd agreement lye and was deteyned by the
sayd ffreighters at Bayon aforesayd for the receaving in of the sayd goods on
board her from the 25th day of August last past to the 28th day of September
last soe that the whole tyme agreed upon betweene the sayd ffreighters
and this deponent for ladeing and unladeing the sayd vessell as aforesayd was expired
and spent before hee this deponent came from Bayon with the sayd vessell and
goods And hee further saith the sayd vessell after her comeing from Bayon
aforesayd was with her ladeing aforesayd surprized and taken by the Tyger
ffrigott in the imediate service of this Commonwealth and by the Commander thereof
brought up to this Port of London where shee hath bin deteyned wver since the
7th of October last untill the wighth day of this instant december on which
day and not before this deponents aith the Commissioners of this Commonwealth
for prize goods did pay unto this deponent the freight due to him this deponent
for all the goods seized in the sayd vessell soe that before that tyme hee
this deponent could not goe away with the sayd shipp Elizabeth but was thereby
constretned to lye at this port of London forty and two dayes before the sayd goods
were unladen and taken out of the sayd shipp and wayters belonging
to the sayd Commissioners continued aboard the sayd shipp during the sayd
two and forty dayes and hee this deponent did pay the sayd Commissioners for
prize goods for their wayetrs attendance during the sayd 42 dayes And further
hee cannot depose saving hee saith that as hee verily beleeveth and in his this
deponents Judgment this Commonwealth of England doe in this case succeede
in the place and [?stead] of the freighters allegate and ought as hee this
deponent beleeveth to pay all manner of payments which the sayd ffreighters
did contracte for and give to pay./

To the Interrogatories. [CENTRE HEADING]

To the first Interogatorie hee saith hee is promised nothing by Evert Gislin Interrogate
nor any other of the Owners of the shipp Elizabeth in case the demorage Interrogated
bee adiudged to them nor expecteth any benefitt thereby only what wages shall
become due to him for the tyme hee hath bin deteyned longer then the agreement
made betweene the Owners and this rendent./

To the second Interrogated hee saith the Elizabeth Interrogate began to deliver her goods
which were seized on board her to the Officers for prize goods appointed to receave the same
about the 10th day of November last and the sayd shipp was [?cleerely] unladen by the
sixteenth day of the saud moneth as hee beleeveth and otherwise saving his foregoeing deposition
hee cannot answere./

To the third Interrogatorie hee cannot answere not knowing the date of the decree
Interrogate nor the date of the order of the Commissioners Interrogated thereupon
made
