is now, as hee beleeveth, remaining in the Registry of this Court, and the third
in the Custody of the said Gerard Ryper, And saith That the said shipp the
White Angell being in her Course from Cadiz towards dDunquirke was mett
withall surprized and taken together with her lading, and the peeces of eight predeposed
as hee verily beleiveth together with one of the bills of lading predeposed, by some of the
shipps of this Commonwealth, and broughtup to London, The premisses hee deposeth
being as aforesaid Cashier and Book keeper to the said producent, and by meanes
thereof well acquainted ed with and versed in the whole negotiation, and haveing
perused and copied the letters of advise sent from the said producentto his said
ffactor for and concerning the lading of silver for his accompt, and having also
seene and perused a letter of advise from the said ffactor to the said producent intimating
that hee would, and aftewards another that hee had actually laden the said
peeces of eight aboard the said shipp for the accompt predeposed, and that the
said Master had signed bills of lading for the same as is predeposed And otherwise
saving his subsequent depositions hee saith hee cannot depose, saving that this deponent
upon the sight and perusall of the said letter, bill of lading and factorie for the said
sylver, entred the same into the booke of accompts of the said producent/:-
To the 6: and 7:th hee saith, That the said producent is an Antwerper
borne, as hee beleeveth, and for such is commonly accompted, and is a Merchant
of Antwerp and a Subject of the King of Spaine, and hath for 7 yeares last
past of this deponents knowledge, and for many yeares before, as this deponent
hath observed by his bookes of Accompts, drive (sic) a trade, and sent severall goods
and Merchandizes from fflanders to Cadiz and Saint Lucar in Spaine to his ffactors
there abideing, to be there disposed of for his accompt, and returnes to be made
for the same in silver money or goods to him in fflanders And saith That no dutchmen
or ffrenchmen Subjects of the King of ffrance or of the States of the United Provinces had or have any
right title or interest in the said peeces of eight predeposed. The premisses hee
deposeth and knoweth being as aforesaid Cashier and booke keeper to the said
producent, and having so been for 7. yeares last past or thereabouts. And
otherwise hee cannot depose, saving his foregoing and subsequent depositions to which hee referreth/:-
To the 8th hee sait, That the said producent for divers yeares Last past hath
received from Cadiz divers baggs of money for his owne accompt under the
aforesaid marke in the margent being one of the two usuall
markes of the said producents goods imported or exported for his use, though the
same have in the bills of ladeing been only expressed as in this present bill of
Ladeing now showne unto him without any mention of the producents name
And saith it hath been and is often used by Merchants useing the trade of
Spaine for silver, to have the same consigned in that manner without any mention
of the Owners name. Which hee knoweth by frequent experience and
observation both of his said Masters affaires, and by familiar acquaintance with
Merchants and their Cashiers at Antwerp. And otherwise cannot depose
