Transcription

then made by the said [?Case] then present in Court that their
goods have bin delivered unto the said Abdy and the rest
of the said parties out of the said Custome house ever since
the 6th or 7th of ffebruary last did decree the said sureties to be
attached et cetera in case they shall not performe the same by Satterday
next in the presence of Suckley dissentinge./.

Godolphin Judges et cetera in the dyninge chamber et cetera in the presence of
Samuel howe Notary publique
Appeared the said Job Throgmorton to
whom the Judges at dyers petition administred an oath to
make a true answeare to the allegation
against him on the behalfe of the said Vivian
and monished him to give in his answeare the first
Court day of the next teareme./.

Which day the said Suckley appeared
for John Baptista younker and made
himselfe party for him and alleadged that
the said shipp doth belonge unto him and
produced for a suretie Samuell Put of
Gabriel ffenchurch merchant who submitting
himselfe et cetera obliged himselfe et cetera for the said
John Baptista younker in the sume of 500 li of
lawfull money of England to the said George England
and others to restore the said shipp and her tackle and
furniture or to pay the value of the same according to the
appraisement thereof to be taken by authority of this Court
in case this Court shall adjudge the same to the said England
and others with expences of suite in case he shalbe over throwne
And unles et cetera which caution the Judges receaved and decreed
the said shipp to be appraised by Commissioners on both sides./.

Which day the said Smith alleadged that it is not
fully answeared to the allegation given in this cause
against him referringe himselfe et cetera and therefore he
desired him to be decreed to be monished to give a fuller
answeare to the same in the presence of ffrancklin dissentinge
and alleadging that the same is fully answeared referringe
himselfe et cetera The Judges upon reading the said answeares did decree
the said Gold to be monished to appeare upon munday next in the
afternoone to make a fuller answeare to the said allegation./.
