The thirtieth day of March 1661/ [CENTRE HEADING]

On the behalfe of Captaine}
Mathew Pennyer touching}
the seizure of the Charles}
by the French}

Examined upon an Allegation given in on behalfe
of the said Mathew Pennyer./.

dt. Captaine Pennier.

Henry Booth of London Gentleman aged
66 yeares or thereabouts sworne and Examined
saith as followeth./.

To the jst article of the Allegation hee saith and deposeth, that in or about the
monethes of June July, and August 1649, the arlate Mathew
Pennyer was Captain, and Comander of a certaine
Frigott then Commissionated by his Majesty Charles the second
by the grace of God King of England, Scotland, France and Ireland,
defender of the ffaith et cetera, or by his Royall Highnes, James Duke
of Yorke, but the name of the said ffrigott hee saith hee doth not
now Certainely remember, but beleeveth that shee was then
Called the Charles, And further to this article hee saith hee cannot
depose./.

To the 2d 3d 4th and 5th articles hee saith that in or about the foresaid months
in the said Yeare 1649. the said Captaine Pennyer with his said
ffrigott was brought into the haven of Calice in ffrance, by a ffrench man , or
ffrenchmen of warr, which had seized the said ffrigott, off at Sea, with
a Great Summe of money onboard her, and many utensills and necessaries
as this deponent was Credibly Informed after the said ffrigotts bringing
into the said haven of Callice but the Vallue of the same hee saith
hee knoweth not, And saith that after the said Captaine Pennyer
was with his said ffrigott brought ito the said haven, hee the said
Pennyer was put into the Common Prison at Callice, and not allowed
any Provision but what hee paid for, which hee knoweth for that hee was
Agent for his Majesty of England at Callice, and frequently went
to see the said Pennyer in the said Prison, And further saith that
the said Pennyer was detained and kept in the said Prison for
the space ofabout two or three months, and being then lett out
were forced to depart thence without receiving any satisfaction for
his said ffrigott, money, utensills and necessaryes seized in her or
abuses done unto him, that this deponent Knoweth of. And further
deposeth not./

To the last hee saith his forgoing deposition is true./
