Manoell Sorrell and others against the}
shipp the Agreement and against hall.}
Examined upon an allegation on behalfe of the said
Sorrell and others

Francis Church of Ipswich in the County of Suffolke Mariner
aged 54 yeares or thereabouts sworne and examined.
To the first and second articles of the said allegation hee saith and deposeth that hee
well knoweth the shipp the Abigail arlate and hath donne for theise seaven
yeares last, and alsoe well knoweth Manoel Sorrell henry Couzens and
company, who hee saith were the time arlate owners of the said shipp and for
such commonly accounted, and saith that in October last were laded
aboard her for their account in the port of Newcastle thirteene score chaldron
of Newcastle coales (or thereabouts) London Measure to be thence transported
in her to this port and there to be delivered and disposed of for their account.
And that having soe received them the said shipp well fitted, furnished and
manned departed from Newcastle with her said lading for this port, and
on or about the five and twentieth day of the said moneth of October last, comming
in her passage neere Cromer about seaven leagues from Yarmouth, the
shipp the Agreement arlate (John Hall master) that was in her company
clapping her helme [?alee], came shearing up with the Abigail, and soe
neare that the master an company of the Abigail fearing her comming
fowle of them, called out aloud and earnestly to the company of the Agreement
to starr board their helme, and take more sea roome and beare
further off from the Abigail which was in shoale water and
as neare the shpare as shee could goe without danger, to whch answer
was retourned in a very tart manner by some in the Agreement, who
said aloud, what a pox ailes you, are you afraid doe you thinke wee
doe not see what wee doe, or words to the same effect, all which hee
deposeth being one of the Abigails company and seeing and hearing the
premisses, And otherwise deposeth not.
