afterwards comming aboard her said the Governour had given leave
for their going into the harbour to supplie themselves, and soe daid some souldiers
and a pilot that come with him from the Governour, whereupon in confidence
of honest dealing they went into the harbour, whither when they were come
under commannd, namely the same day of their comming in, the said shipp salt
and goods were by the Government order seized, and confiscated, and after
such seizure the said Tompson and company (whereof this deponent was one)
were there detained prisoners, for the space of
thirteene monethes, and their said salt and goods were taken out and
sold, and the shipp disposed of with her tackle and furniture by the said Governour
and his order, whereby the said Tompson and company were and are utterly
dispoiled and deprived thereof, of this deponents sight and knowledge. And
otherwise hee cannot depose.
To the sixth hee saith that the said shipp the Small Mallaga Merchant
at the time of the said seizure and [?spoile] with her tackle apparell and
furniture and lading, were well worth the summe of two thousand and
foure hundred pounds sterling, and soe much the same would have
yeelded at New-England in case they had come in safetie thither. And
otherwise hee cannot depose.
To the seaventh hee saith that the said Tompson and his mariners
by reason of their said imprisonment have in expenses, losse of time
and othe hinderance bin damnified to the summe or valew of five hundred
pound sterling and upwards.
To the eighth hee saith that the said Tompson and company of owners by reason of
the losse of their said shipp and goods and through want of the imployment
of the money which the same would have yeelded besides the principall
have in his estimation suffered losse and dammadge to the valew of
1000 li sterling.
To the nineth hee saith that the said Tompson and company at Santa domingo
aforesaid by [?satisfaction] and applications to the Governour and
otherwise used all the meanes they could for recovery of the said shipp and
goods, but could in nothing prevaile the Governour finally answering hee would
keepe them for the accompt of the kinge of Spaine, or to that effect.

Peter Butler of London Mariner aged 38 yeares or
thereabouts sworne and examined.
To the first article hee saith and deposeth that hee well knoweth the
producent John Thompson and hath soe donne for theise foure or five yeares
