And that from the time they came from haver de Grace, they were
soe farr from declining meeting with the English, or making or setting
up any more saile to that purpose, that they steered and held their
course with the said shipp for the coast of England, and most convenience
and safe for them (the winde and weather considered) to saile for
Cadiz, and this was (hee saith) true and notorious, which hee knoweth
being steersman of the said shipp as aforesaid and having longe used sea faring
and thereby well knowing the premisses. And otherwise hee cannot depose

To the first hee saith hee had for his owne accompt in the said shipp at the time of her seizure
six tonnes of tobaccoe pipes, and a hogshead of tobaccoe pipes, and a tonne
of flax, nine rolls of tobaccoe, whereof three are sold, 164 cheeses
(which are alsoe sold by this deponent together with the said three rolls
of tobaccoe) 25 pounds of cloves, one box of lace containing 724
dutch ells, at 8 stivers the ell, two packs of haberdasherie, 28
belts, at 10 gilders and a halfe a peece one with another. 6 dozen of
hatbands, 2 peeces of linnen, containing 63 ells at 3 s the ell Hollannds:
twelve feathers for hatts at 10 stivers a peece, and 5 dozen of [?poinmt?s]
at 5 stivers the dozen: the restitution whereof hee saith he cannot
call an advantage, because hee is a freeman in respect of this
commonwealth, and that they ought to be restored unto him, And
otherwise hee cannot depose.
To the second hee saith that hee was warned or told by the master
of the said shipp that hee was to come and depose the truth
in this cause. And otherwise hee cannot depose, saving hee hath
not bin instructed howe or to what purpose hee should depose.
To the third hee referreth himselfe to his foregoing deposition.
To the last hee hath not soe deposed.

Examined upon the foresaid allegation.

David Bruloes of Middleborowe Saylemaker,
aged 2[?X] yeares or thereabouts sworne and examined.
To the third articel of the said allegation hee saith and deposeth
that when the said shipp the hare in the ffeild came the voyage in
question from haver de Grace bound for Cadiz, hee sawe and
observed and heard it commonly said by the mariners of the shipp
that shee steered right for the Ile of Wight as most
convenient for her course for Cadiz, the winde then considered
which to his remembrance was at North East and by North or
thereabouts, and did not use any endeavour to avoide the English
which hee knoweth being one of her company and then aboard her. And
otherwise hee cannot depose.
