The 21th of November 1655. [CENTRE HEADING]

Smith et [?alyn] against Phillips}

Examined upon the foresaid allegation on the behalfe of
the said mariners

William Newland of Limehouse in the County of Middlesex
Baker, aged 24 yeares or thereabouts sworne and examined.

To the first hee referreth himselfe to the Registre of this Court, and
otherwise hee cannot depose.

To the second hee saith that about three yeares since this deponent sawe a
dutch bottome lying on the Cowes in the Ile of Wight called the Joseph
and brought in thither by a shipp of warr set out by Captaine Phillips.
and saith that within the time arlate namely in or about September
1651 this deponents father William Newland of Newport in the Ile of
Wight and companye bought the lading of [?rosin] of the shipp the dolphin arlate brought
in as a prize by a man of warr set out by the said Phillips being in all
with [?rubbish] and [?rosin] together 146 tonnes tenn hundred three quarters and thirteene
pounds, which hee knoweth because hee this deponent was imployed in the
taking it up: and to his remembrance and as hee beleeveth his said father
and company paid six pounds per tonne for the same to the said Captaine
Phillips. And otherwise hee cannot depose.

To the third hee cannot depose.

To the Interrogatories in the first place. [CENTRE HEADING]

To the first hee answereth negatively for his part, and otherwise hee
cannot depose.

To the second hee cannot depose.

To the third negatively for his part and otherwise hee cannot depose saving as
aforesaid and what followeth.

To the fourth and 5 hee cannot answer.

To the Interrogatories in the second place. [CENTRE HEADING]

To the first negatively for his part ad otherwise hee cannot answer.

To the second hee cannot answer.

To the third hee saith that when his said father and company had bought the
said [Rosin], the mariners then belonging to Captaine Phillips his man of
warr (named the Constant) would not suffer the same to be delivered till
order were taken for their shares, and after wards hee saith that Captaine
harley commander of the Constant gave order for the payment of the summe
of 300 li (out of the money payable for the [?rosin]) for the mens wages to
John Searle and the same was paid accordingly, and this deponent hath his
receipt for the same. And otherwise hee cannot depose.

To the fourth hee cannot depose.

To the fifth hee referreth himselfe to his foregoeing deposition and cannot otherwise
answer.

To the last negatively for his part, and otherwise hee cannot answer.

Repeated before the Judges in Court.
