The 13th of January 1654. [CENTRE HEADING]

On the behalfe of Vincent de la Barr and}
Thomas delaval concerning an averdige in}
the John of dover. Assurance.}

Edmund Saunders of Redriffe
in the County of Surry Mariner
late commander of the said shipp the
John of dover aged 33 yeares or thereabouts
sworne before the right worshipfull William Clarke
doctor of lawes one of the Judges of the high Court
of the Admiraltie, and examined upon certaine
Interrogatories ministred on the behalfe of the said Vincent
dela Barr and Thomas dela Val, saith and deposeth
as followeth videlicet.

To the first and second Interrogatories hee saith and deposeth that
hee well knew and was commander of the said shipp the John of
dover at the time of her last being at Saint Lucars and
Cadiz in Spaine, (which waas in the yeare 1652) and thence bound
for this port of London, And saith that hee hath well knowne
the producents Vincent delabarr and Thomas delaval for theise
tenn yeares last, and that at the time of the said shipps departure
from Cadiz homewards the said voyage they were the sole
owners of the said shipp and pf her tackle, apparell and furniture,
which hee knoweth because this deponent was constituted master of her
by them the said delabarr and delaval who hee saith fitted
and sett her out the said voyage as sole owners of her. And
further that shee departeds from Spaine on the said homewards voyage
in or about the moneth of January of the said yeare 1652, in which
said homewads voyage, in the latitude of 45 degrees and a halfe
shee was met with by a Squadron of shipps under the command
of Prince Rupert, which chased and endeavoured to take her, and
that the said shipp the John fought and defended herselfe (as
much as shee was able) from about eight in the morning till
about three of the clock in the afternoone with greate hurt and dammage
namely hee saith that in the said fight shee received about 150 shott
from the said Squadron in her masts, sailes, rigging and hull
whereby the same were very much torne and battered, the charge
of the repaire and amending whereof and to make the said shipp
therein as good as shee was before the said dammage received, came
to and cost her said owners fifteie pounds sterling, all which hee
knoweth being master as aforesaid and seeing the premisses soe
donne, and laying out the moneys (on behalfe of the said owners)
in and for such her necessarie repaire of the hurt and dammage
sustained by the said fight and chase, wherein it pleased God
to deliver her from being taken by the said Squadron. And
saith that since the said voyage and fight namely about a yeere
since, the said shipp, tackle and furniture were sold for 255 li
sterling and noe more, which hee knoweth being privie to the
said sale and receiving the said moneys on the behalfe and to the
use of the said owners And otherwise hee cannot depose.
