Transcription

To the second article hee saith and deposeth that in or about the moneth of
May 1655, the said Peter Ayrall at Porto aforesaid laded aboard the said shipp
the Orangetree three chests of sugar of the marke in the margent for the accompt

EVR [MERCHANT'S MARKE, LH MARGIN]

of them the said Peter Ayrall and John Taviell to be transported in the
said shipp to Roane and there to be delivered to Beniamin Benzalin their factor
or correspondent, as hath appeared to this deponent by the Accompt of the said
sugars, which hee hath seene, And otherwise hee cannot depose.

To the third hee saith hee hath seene the said Taviells letter to Mr Castell
declaring that the said Ayrall had consigned the said sugars to the arlate Abraham
Pelt Phillips of Amsterdam and as for the said Phillips his accompt, mearely
to conceale their foresaid right prioprietie from the enemies arlate and to
preserve them from seizure, and that the bill of lading soe made for
Amsterdam was mearely pro forma for the reasons aforesaid, and saith hee
hath seene a Notariell Act whereby the said Phillips hath soe declared, and
that the said sugars were belonging to the said Taviell and Ayrall, And otherwise
hee cannot depose.

To the fourth article hee saith hee hath seene the letter containing the notice arlate sent from
the said Taviell to Mr Castell, and a factory of the said sugars, and saith
the said Taviell is commonly accompted a merchant of good repute and qualitie
at Lile in fflannders, and otherwise saving as aforesaid hee cannot depose.

To the Interrogatories hee referreth himselfe to his foregoing deposition and saith hee is
an English man borne, and otherwise negatively.

To the seceond and 3 negatively for his part, and otherwise hee cannot depose saving
as aforesaid.

To the fourth negatively.

To the fifth hee saith he doth not knowe the said Beniamin Benzelin, and
otherwise hee cannot depose.

To the 6 and 7 hee cannot depose.

To the 8 hee saith the said goods predeposed to be sebt by the said Ayrall to the
said Taviell and seized and brought up into England and afterwards here
cleared (being oiles) came in the shipp diamond, Peter [?CXXX] master, and
goods have bin sent hence by Mr Castell to the said Ayrall by order of the
said Taviell since the shipp James, Richard Griff{?is] master, and others in a
shipp whereof Robert Bancks was master, And otherwise hee cannot depose
saving as aforesaid.

To the 9th hee saith the said advice and notice from Mr Taviell to Mr
Castell came by the post in a letter from Lile, And otherwise hee
cannot depose, saving as aforesaid.

To the 10th hee saith hee cannot depose, not knowing ought thereof.

Michael Castel of the citie of London Merchant aged 68 yeares
or thereabouts sworne and examined.

To the first article hee saith hee hath knowne the producent John
Taviell for theise twenty yeares last past and Peter Ayrall hee
knoweth only by correspondence, and hath soe donne for severall yeares
last past, and this deponent for severall yeares last corresponding
