before a Master of the Chancery every of them make oath of the
reality of their propriety in the sayd shipp Saint John Baptist and her
ladeing now in question seized (as by the proceedings in their cause may
appeare) by the arlate Captaine Robert Sedgewick and Captaine John Leveret,
And hee beleeveth that the sayd Arnold Beake and Eias Beake and Company
Owners of the sayd shipp and goods did after publique Summons made upon
the Exchange London Examine certaine witnesses for the proveing of their
propriety in the sayd shipp and ladeing seized by the sayd Sedgewick
Levert and others, and for the more certainty thereof referreth him selfe to the
REgistry of the sayd Court of Admiralty where the same was soe acted
and donne And hee saith that the sayd Arnold and Elias Beake and Company
understanding their sayd shipp and goods were carried (after seizure)
by the sayd Sedgewick Leveret and others) towards New England did sebd this
deponent with full power from them and in their name to demande
of the sayd Sedgewick Levert and others who seized her the sayd shipp and
her ladeing seized on board her or at least full satisfaction for all damage
susteyned thereby in case the sayd shipp and goods were disposed of and sold
by the sayd seizers, and this deponent being soe authoriized, and alsoe
by the sayd Arnold and Elias Beake and Company furnished with coppyes
of the examination of witnesses taken as aforesayd in this Court touching
the propriety of the sayd Arnold and Elias Beake and Company to the sayd
shipp and goods for the cleerer manifestation of their tytle thereto, subscribed
(as to this deponent appeared) by the arlate Edmond Arnold, and other
Notaries for the better confirmation thereof, and alsoe with the originall
affidavite made by the sayd Arnold and Elias Beake John dolins
and Thomas Greene before a master in Chancery did togeather with his contest Thomas Wood (who
was alsoe by the sayd Owners appointed to goe with this deponent and
to assiste him in the recovery of the sayd shipp and goods) departe
forth of the downes in the shipp the hopewell (whereof one James Garett
was Commander) on the fifth day of May 1654 with intente to sayle
to New England to looke after the sayd Shipp and ladeing, and this deponent
carried the sayd Coppies of the examinations attested as aforesayd and the
originall affidavitts aforesayd with him, by which affidavits and examinations
which this deponent read over and perused it did to him cleerely appeare that
the sayd shipp the Saint John Baptist and goods seized therein did belonge
to the arlate Arnold and Elias Beake and Company Merchants of
London and dover and this deponent verily beleeveth them to bee the true Owners
of them And further saving his subsequent depositions hee cannot
depose./
