Transcription

To the 5th hee saith hee referreth himselfe to the Registry of this
Court as touching the Contents of this article and further cannot depose

To the 6th article of the sayd libell hee saith and deposeth that for the
reasons aforesayd hee well knoweth that the arlate George Abbott
did at the sayd shipps the Phenix her departure from Virginia the
voyage in question cause to be laden on board the sayd shipp sixty
seaven hogsheads of Tobaccoe marjked with GA which Tobaccoes
were by the sayd George Consigned by bill of ladeing to the arlate
Mathew Abbott And
further to this article hee cannot depose./

To the 7th hee saith the arlate George and Mathew Abbott are commonly
reputed subiects of this Commonwealth, and as hee beleeveth are subiect
to the Jurisdiction of this Court./

To the 8th hee saith saving his foregoeing deposition to which hee
referreth hee cannot depose/

To the last hee saith his foregoeing deposition is true/

Examined upon the sayd libell./

Nathaniell Butcher of the parish of Saint Mary
Bowe London aged twenty three yeares or thereabouts
a witnes sworne and examined saith and deposeth as
followeth videlicet./

To the first and second articles of the sayd libell hee saith that within
the tyme arlate and within the moneths arlate in the yeare 1652 arlate
hee this deponent being servant to the producent Ralphe Wingfeild well
remembreth that there were then divers goods wares and Merchandizes packed
up to be sent in the arlate shipp the dolphin the arlate Edward Gunnell Master to Virginia and hee
this deponent helped to pack up a great part of them, and hee saith that
the arlate George Abbott being to goe in the sayd shipp to Virginia, the
sayd goods were to bee sent in the sayd shipp to Virginia by the
sayd George Abbott, who was by agreement made betwixt him the sayd George
Abbott and the sayd Ralphe Wingfeild to returne to him the sayd Wingfeild
in liew of the sayd goods as alsoe of fforty pounds in money which by the sayd Mr
Wingfeilds booke doth to this deponent appeare to have bin paid by the sayd Wingfeild to the sayd
George Abbott and others to his use and by his appointment, the value thereof
with the profitt made of the same in Virginia Tobaccoes, but this deponent
was not present when the sayd Contract was made but by severall letters
since
