Ralphe Wingfeild against 67 hogsheads of}
Tobaccoe laden aboard the shipp the Phenix of which
ffrancis Steward is Master by George Abbott in}
Virginia and consigned to mathew Abbott and against}
the sayd mathew Abbott comming in for his interest
and against whatsoever persons intervening or appearing}
in Judgment herein. Clements}

Examined upon the Libell given in on the behalfe
of the sayd Ralph Wingfeild/

of Stepney and County of Middlesex mariner
Purser of the shipp the Phenix in the sayd
libell mentioned aged 21 yeares or thereabouts
a witnes sworne and examined saith and
deposeth as followeth

To the first and second articles of the sayd libell hee saith hee cannot
depose, knowing nothing touching the contents of them./

To the third and fowerth articles of the sayd libell hee saith and deposeth
that hee well knoweth that the arlate Ralphe Wingfeild did in or about
the moneths of November or december in the yeare of our Lord God 1653
(the tyme more certainly hee doth not now remember having not his freight booke which
hee kept as Purser about him) cause to be laden on board the shipp Phenix arlate
whereof the arlate ffrancis Steward was master fower smale barrells one
Virginia hogshead, one drye fatt and a smale bale of goods or Merchandizes
marked RW all which goods by bill of ladeing were consigned to be
delivered in Virginia to the arlate George Abbott or to his Assignes as by
the bill of ladeing made for the same may appeare which goods were soe shipped
aboaard the sayd shipp within the Jurisdiction of the Admiralty Court arlate and
were in the sayd shipp safely carried and transported to Virginia, and there delivered
drye and well conditioned to the sayd George Abbott who came aboard the sayd
shipp in Virginia and with a sloope of his owne provideing caused the sayd goods
to be taken from on board the sayd shipp into his owne possession and custodie
The premisses hee deposeth of his knowledge for that he was purser of the
sayd shipp during the sayd voyage and tooke notice in his booke of the sayd goods
at the tyme of their ladeing aboard the sayd shipp and of the marke and number of them
and alsoe sawe them delivered safely at Virginia to the sayd George Abbott And
further to these articles hee cannot depose (not being privie to any agreement or
contract made betweene the sayd Wingfeild and Abbott nor to any power
conferred by the sayd Wingfeild to the sayd Abbott for receiving any moneys
due to him the sayd Wingfeild in New England arlate) saving
hee saith that for the reasons aforesayd hee alsoe well knoweth that
the sayd George Abbott did in Virgina lade on board the sayd shipp the
Pheonix at her returne from thence Twenty hogsheads of Virginia
Tobaccoe marked RW and consigned them to be delivered to the sayd
Ralph Wingfeild at London which twenty hogsheads of tobaccoe were
of this deponents like knowledge safely delivered to the sayd Wingfeild
according to the sayd consignation./
