And otherwise saving his foregoeing deposition hee saith hee cannot depose:-
To the 5th article hee saith hee referreth himselfe to his precedent depositions
And to the Acts and proceedings of this Court, And further cannot depose
saving hee beleeveth the said producent is damnified by the detention of the said
freight, besides the freight it selfe, the summe of thirtie or fortie pounds.
which hee mght in all probability have benefited by the employment of the said
freight./
To the Crosse Interrogatories:- [CENTRE HEADING]
To the first Interrogatorie hee answereth and saith, That hee this rendent
cometh to declare the trueth of his knowledge in this Cause at the request
of John Salmon the producent, and was as adoresaid Boateswaine of the
said shipp the Voiage in question, and can write and reade, and hath longe
since received all his wages due for the sayd Voiage, and saith this rendent
is bound to Sea as Boateswaine upon another Voiage with the said Salmon.
To the second hee saith, hee doeth not know nor remember that any person
did send or come on board the said shipp to demand the said sugars at or neere dover, nor knoweth to whom they were
to be delivered there, neither did the said shipp make any stay at the
places interrtae, nor knoweth of any such protest, as is interrate:-/
To the third negatively for his part And further cannot depose./
To the fourth hee saith hee doeth not remember, that hee this rendent
sett it downe in any noate or writing how the wind stood at the time
interrate, but hee well remembreth it was then a strong South East wind,
And saith no goods were or could in this deponents Conscience bee without
imminent and apparent danger delivered out of the said shipp at the
time or place interrate. And further cannot depose:-
To the last hee referreth himselfe to his foregoeing deposition:/.

Examined upon the said Libell exhibited on the behalfe of the
said Tetther,.
Simon Driver of the parish of Saint Buttolphe Billingsgate
Cooper aged 49. yeares or thereabouts a Wittnesse seorne and
examined saith and deposeth as followeth, videlicet/
To the first article hee saith, hee knoweth nothing of the Proprietors arlate, nor of any
other having or pretending to have any propriety to the shipp the Julian arlate/
To the second hee saith hee cannot depose/
To the third article or position hee saith, That hee this deponent as Cooper being imployed by
Mr Thomas Allen and others Merchants of London did putt on board the shipp the
Julian arlate in the yeare 1653. (the said Richard Bryan then commonly and generally
accompted Master thereof) twelve hogsheads of Copperes for and upon the accompt
of the producent Mr Anthony Thether and Consorts. And further hee cannot
