The 12th day of ffebruary .1654: [CENTRE HEADING]

Lorenzo de Lara against Peare.}
Suckley. Smith.}

Examined upon the said Libell:-

3us/

George Haughton of London Merchant aged 36. yeares
or thereabouts a Wittnesse sworne and examined saith and
deposeth as followeth, videlicet:-

To the first position of the said Libell hee saith, hee knoweth not the Master
nor the Vessell or Proprietie arlate, And further cannot depose:-

To the 2. and 3. articles or positions of the said Libell hee saith and deposeth
That hee this deponent in the yeare 1650. last past being at Mallagoe in
Spaine about his Merchandizing affaires, and being there familiarly
acquainted with, and lodgeing in the house of the lilate ffrancisco Lorenzo
de Lara, hee there told and acquainted this deponent That some 2. or 3. yeares
before one Peere an Englishman and then Commander of a Certaine
English Vessell lyeing in or neere the said Port of Malagoe in Spaine
entreated the said francisco Lorenzo de Lara to become fidejussor and suretye
ffor him to the kings Officer of Malagoe, that his said shipp should not
depart from thence without speciall permission first obtained from the
said Officer or Officers, whereupon the said de Lara, as hee affirmed to this
deponent did really become fidejussor and surety to the effect aforesaid, and to that
end was obliged in case of breach to pay two thousand duckatts, And
saithm the said de Lara then also affirmed to this examinate, That the said
Peer with his said shipp having an oportunity of wind did in the evening
sett saile from thence leaving the said de Lara engaged as aforesaid,
and that hee de Lara was thereupon proceeded against in the Courts of
Spaine, and condemned to pay, and did really pay the said summe of
two thousand duckatts for and upon the occasion predeposed. And
so much in effect this deponent then also heard and understood by and
from sewerall English Merchants and others then there inhabiting and
residing. And further cannot depose./

To the 4th hee never saw the arlate Peere so farr as hee knoweth
and therefore cannot depose./

To the 5th hee saith, hee referreth himselfe to his foregoeing deposition And
further cannot depose./

To the 6. and 7th hee saith hee referreth himselfe to the Law and to the
Acts and proceedings of this Court And further cannot depose

To the 8th hee saith his foregoeing deposition is true./

To the Interrogatories:-/ [CENTRE HEADING]

To the 1th hee saith hee cometh to declare the trueth of his knowledge
in this Cause by Vertue of Order under the Seale of this Court,
and that he hath no mannner of interest in nor relation to the said Cause
And further otherwise then negatively hee saith hee cannot depose
