sort of Merchandize, and imbraques in a hott countrie and very dry con=
ditioned will in tract of time by remaining aboard a shipp (where in all
probability it atytracts much moysture) become rather more weightie then
when first imbarqued, And further cannot depose./

To the 10th hee saith hee hath no knowledge of the rates given by the
Turkey Companie for the freight of their Merchandizes. And further
cannot depose/:-

To the rest hee is not examined by direction of the ministrant./

sugar seized in the Vessell the Nostra Seniora da Rosario}

Commander of a shipp of warr in the immediate service}
of this Commonwealth. Suckley. Budd.}

Examined upon an Allegation
on the behalf of the said
Andrew Rand, and upon the
schedule thereunto annexed./:

George Whiller of the Citie of Lisbone in
Portugall Merchant aged 25. yeares or there
abouts a Wittnesse sworne and examined./:-

To the first article of the said Allegation hee saith and deposeth, That in or
about the moneths of June and July in the yeare 1650. last past
the arlate Andrew Rand then or not long before Captaine or Commander
of the shipp Thomas and Lucy of London then being under sequestration
at the Bahia in the Brazeele, did then and there cause to be laden and
putt on board the shipp the Nostra Seniora da Rosario arlate (whereof
this deponent then was Commander) Tenn Chests of white sugar marked
as in the margent to be transported from thence to Lisbone in Portugall

AC [MERCHANT'S MAARKE, LH MARGIN]

for and upon the proper accompt and adventure of the said Andrew
Rand. The premisses this deponent well knoweth, for that hee this deponent
being Captaine and Commander of the said shopp the Nostra Seniora
at the time and place predeposed, did see and observe the lading of the said
ten Chests of sugar for the accompt aforesaid aboard the said shipp at the
time and place aforesaid, And to that purpose this deponent concluded and agreed with
the said Andrew Rand to and for the transporting of the said sugars as
is predeposed, And further, saving his subsequent depositions, to which hee
referreth, hee saith hee cannot depose./

To the second article and schedules therein mentioned and thereunto annexed
and now seene and perused by this deponent hee saith and deposeth, That
hee this deponent being the then Master and Commander of the said shipp the
Nostra Seignora da Rosario did about the time of the ladeing of the
goods predeposed signe and firme to three bills of ladeimng all of one tenor
for the receipt of the said goods at the Bahia and for the delivery of
the same to the order and according to the appointment of the said
