To the Crosse Interrogatories [CENTRE HEADING]

To the 1. Interrogatorie he saith he comes to be a witnes in this cause att
the Request of Mrs Pett. and saith he is noe way interested in this
busines. and further otherwise than negatively he cannot depose.

To the 2d he saith the sayd worke was done by the order of the sayd
Allen. and there is not any satisfaction made to the sayd Mr Pett
or his Executrix for the sayd materialls or any of them. And
further or otherwise saving as aforesayd he cannot depose.

Examined upon the Libell.

William Upcher of the libertie of the
Tower citizen and salter of London aged 30 yeares
or thereabouts sworne and examined

To the first article of the said libell hee saith and deposeth that
hee hath knowne the producent John Coleman neare upon twenty yeares
last and that the said Coleman the time arlate and particularly in the
monethes of January and ffebruary of the yeere 1652 (English stile)
was commonly accompted and reputed the lawfull owner and proprietor
of two third parts of the shipp the William and John arlate (which hee
alsoe well knoweth as hee saith) and the arlate John Stephens severall times
about a yeare and halfe since both in the Tower Libertie and in this
citie being in speech with this deponent about the said shipp, hath
said and acknowledged to this deponent that the said John Coleman
was owner of two third parts of the said shipp and of her tackle
and furniture. And otherwise hee cannot depose.

To the second and third article hee saith and deposeth That hee hath
likewise heard the said Stephens say and confesse that the said shipp
was let to freight unto John [?Molham] and George Chandler and by
him the said John Stephens as a third part owner, and that they
had fitted and furnished her out on that voyage at their owne costs,
and that the said Stephens went master of
her that voyage, and otherwise hee cannot depose, saving that in particular
hee hath heard theise acknowledgements of the said Stephens at the house
of Mr Nelson, deputie Marshall of this Court and elswhere, upon
occasion of discourse touching the said shipp and the said Colemans
parts therein/

To the fourth article hee saith and deposeth that the said Stephens
hath severall times made voyages with the sayd vessell
within this yeare and half last from England for ffrance and
back againe for England, this deponent having severall times seene
her
