sayd sylver and a third of the same tenor did remayne with him the sayd
Ryper att Cadiz. And saith that for theis reasons, and having seene oftentymes
the firme of the sayd Michael Ban Lubkin, and having likewise seene a duplicate
or exemplar of the sayd bill of lading remaining in the Registry of this Court
her firmly beleives that the sayd Michael Van Lubkin did firme the sayd
bill att Cadiz and that the Contents thereof were and are true and so
had and done as therein is conteyned. And otherwise he cannot depose.
To the fifth article of the sayd allegation this deponent saith that the sayd Edward
Peters was and is an Inhabitant of Antwerpe in Brabant and
a subiect of the King of Spaine, which he knoweth being his Cashier
as aforesayd; And saith tat the sayd shipp with the sayd sylver and money
in her was in her Course from Cadiz seized and deteyned by some
shipps of warr belonging to this Commonwealth as he beleiveth And
otherwise cannot depose.
To the last he saith his depositions are true.
To the Crosse Interrogatories [CENTRE HEADING]
To the first negatively.
To the second he saith he hath knowne Edward Peters Interrate 6 yeares and
William Jansen for .6. yeares by correspondencyes, and Geraerl Ryper in like
manner 4 yeares, and otherwise saving his foregoeing depositions hee
cannot depose, saving that he this Rendent never was att Cadiz.
To the third he saith that Wiilliam Jansen and Geraerl Ryper interrate are
the producents factors, and otherwise saving his foregoeing depositions
he cannot depose,
To the fourth he saith the sayd Edward Peters is a native of Antwerpe in Brabant
and hath there lived about five yeares, and before that for many yeares
lived in Dover in Kent and saith that by common repute William Jansen
is by birth an Hamburgher, and hath many yeares lived with his wife
and family in Cadiz, and by common repute the sayd Gerart Ryper is
by birth an Antwerper and hath lived in Cadiz 13: or 14 yeares. And otherwise
he cannot depose.
To the fifth he saith he being not att Cadiz att the tyme of lading the
sylver in question cannot depose otherwise than he hath predeposed
