depart shortly after the lading of the said 600. peeces of eight for the accompt
aforesaid, videlicet in or about the moneth of May last past (as this deponent now remembreth
the time) saw and perused at Antwerp the bill of lading annexed to the allegation
or one of the same Contents, being sent in a letter of advise together with an Invoyce
from the said ffactor to the said producent at Antwerp by the Ordinary land poast
for and Concerning the ladeing of the 600 peeces of eight for the accompt predeposed
And saith hee hath bin Credibly informed that the said shipp being in her Course
from Cadiz towards Dunquirke with the said moneys and a bill of lading of the
same tenor with the bill annexed was mett withall surprized and taken by some
of the shipps of the Parliaments ffleete and brought up to London, and that the said
second bill of lading is now remaining in the Registry of this Court. And this
deponent by reason of the familiar Correspondencie between his Master one Edward
Peters a Merchant of Antwerp, and the producent in this Cause, being usually and
frequently admitted to peruse, and oftentimes employed in dispatch of businesse for
the said producent, and well acquainted with his bookes of accompts, did shortly after
the receipt of the said bill of ladeing letter of advise and Invoyce, see the said
600 peeces of 8/8 entred into the said producents booke of accompts, and that the said
Gerard Ryper was Credited for the same, and by frequent observation of the usual
handwriteing of the said Gerart Ryper, this deponent is fully assured that the
bills of ladeing annexed was and is really filld up by him the said Gerard Ryper
and that the Contents thereof are reall and true and no way fictitious or
Colourable. And otherwise saving his following deposition hee saith hee cannot depose.
To the 6. and 7th hee saith, That the said John Smeesters the producent
is commonly and generally esteemed a Native of Antwerp and is a Merchant of good quality there
and a Subject of the King of Spaine, and hath for severall yeares last past of
this deponents Certaine knowledge driven a trade to Cadiz and Saint Lucar in Spaine
sending goods to his ffactors residing there and receiving returnes in mony
plate and bullion from thence, And saith the marke in margent
formerly expressed was and is one of the usuall markes under which the
said producent usually sendeth out and receiveth the goods Merchandizes and
moneys to him belonging, And that no Dutchmen or ffrench Subjects in the
States of the United Netherlands or King of ffrance had or have any title
or interest in the silver rpredeposed or any part thereof, The premisses hee knoweth
being by the meanes predeposed familiarly and intimately acquainted with the
negotaiation of the said producent, and haveing for severall yeares observed the marke
predeposed to be made and used upon goods merchandizes and baggs of money
transmitted by, or consigned to the said producent. And further hee cannot
depose./
To the 8:th hee saith, That the said producent of this deponents certaine knowledge
hath for severall yeares last past received baggs of money and peices of plate
for his owne use and accompt merely upon Consignation to the marke predeposed
without any expression of his name at large in the bill of lading, and it is
usuall and commonly practized amongst Merchants to Consigne money from
