that his Clients had certaine witnesses ne … that his Clients had certaine witnesses necessarie to prove the<br />
intents of the said libell in the Countrey in parts<br />
farre remote from this Tribunall Wherefore hee<br />
prayed a Comission to bee decreed for examination of<br />
witnesses at Biddeford in the County of Devon the said<br />
Budd dissentinge Butt the Judges at Cheekes petition<br />
did decree a Comission for examination of witnesses on<br />
his Clients behalfe and committed unto ffrancis ffarie<br />
Humphrey Prideeaux Mathew Hatch and William Shibber<br />
gentleman Comissioners named by Cheeke to sitt in the Townehall<br />
of Biddiford the third foarth and fifth daies of<br />
September next ensueing the date thereof with<br />
continuation etcetera Assuminge etcetera< And monished Budd<br />
to attend the daies and place aforesaid if etcetera and<br />
assigned Cheeke to transmitt the said Comon the<br />
second session of Michaelmas Tearme next./

Which day Cheeke alleadged that<br />
it is not fully and plainly<br />
answeared by ffrancklins Client<br />
to the twoe last allegations given against<br />
him in this cause referring himselfe etcetera<br />
Wherefore hee prayed the said Gridden to bee<br />
ordered to give more full and plaine answeares in<br />
the presence of the said ffrancklin dissentinge and<br />
alleadging that it was fullie answeared referringe<br />
himselfe etcetera Whereupon the Judges assigned to heare<br />
theire order on Cheeks petition the next Court<br />
Day./.

make for their respective parties, and then the<br />
Judges att Cheekes petition did continue the cause<br />
untill the next Court day Watson dissentinge and<br />
giving an allegation in writinge which hee desired to bee<br />
admitted in the presence of Cheeke dissentinge and<br />
alleadginge that the same doth not conclude etcetera soe<br />
that the Judges assigned to heare their pleasure on<br />
Watsons petition th enext Court day Cheeke<br />
dissentinge./.
