Transcription Confession of the truth of it [?XXXX] of CConfession of the truth of it [?XXXX] of Clements or his [?XXXX XXXX]<br /> [?XXXX XXXXX] they shall prove any thing materiall in [?XXXXXX] he<br /> [?XXXXX XXXX]he should submitt such order as the Courte<br /> should [?XXXXXX] most agreeable to Justice, and that if the said<br /> Clements would set downe in his paper the admission of his allegation<br /> [?what hee desires], he would presently [?XXXX] to it what hee did confesse<br /> and the said Suckley did further alleadge that the matter<br /> was referred to mr Clements paper and hee had often<br /> called to him for it and he had not brought it soe that it was<br /> his owne fault but he is ready still to doe it and now his Clyents<br /> being produced they will acknowledge presents of the fact soe that<br /> there wilbe now need of a Commission Clements dissenting and desiring a Commission<br /> and his cause to be continued untill the next Cort day and Justice etcetera but the<br /> Judges at the action of Suckley did publish the depositions of the<br /> witnesses and assigned this cause to sentence the next Cort day saving<br /> [?his] Clements answeres Clements dissenting and protesting et cetera Thomas Browning against Vanderpost Till}<br /> and others Clements Suckley} Which day the Judges at the petition of<br /> Clements assigned this cause to sentence<br /> upon the next Cort day uppon the<br /> first assignation in the presence of Suckly<br /> sissenting/ Hall against the ship the Accord}<br /> against Hill and Hopford Clements} The like at the petition of Clements<br /> in the presence of ffrancklyn<br /> dissenting etcetera Tison against Scott}<br /> Smith Clements} Which day the Judges at the petition of Smith<br /> sid assigne this cause to sentence the next<br /> Cort day Colequite dissentinge. Hazard and Tilley and others}<br /> against Scott Smith Colequite} The like Robert Russell against the shippe}<br /> the ''John'' and against Alderman}<br /> Hooke of Bristoll}<br /> and others} Which day Smith did exhibit<br /> his proxy for the said Russell<br /> and made himselfe partie for<br /> him and Cheeke for the said<br /> Hooke and Company and made<br /> himselfe partie for them in whose p<help>XXX</help><br /> Smith gave a libell in writinge which the<br /> Judges at his petition did admitt etcetera which beinge<br /> admitted and repeated etcetera Cheeke not beleevinge the<br /> same etcetera the Judges did decree for the partie<br /> principall the third day after it etcetera and assigned<br /> mith to prove the same the same the third<br /> Session from hence etcetera Then Smith upon the said<br /> libell produced John Blith and James Norris whom<br /> the Judges receaved and administred an oath unto<br /> them to bee examined before the next Cort day<br /> Cheeke dissentinge etcetera and havinge for Interrogatories<br /> the usuall time et cetera./.s<br /> the usuall time et cetera./.  +
