and others aforesaid beinge spoe possessed … and others aforesaid beinge spoe possessed of the said estate<br />
for the purpose aforesaid did sell assigne make over<br />
the said fourth part pf the said shippe unto the said<br />
William [?Taddurian], and the said Crandley and<br />
Throgmorton did then offer and undertake to give<br />
securitye for the makinge good the said 4th part<br />
of the said shippe to the said hannibal Vivian together<br />
with the interest for the value of the same after the<br />
value of six poundes per Centum whensoever this Court<br />
shall adiudge the said 4th part to the said Vivian<br />
and to secure the said Vivian from all manner of<br />
hazard which shall be runne touchinge the said parte<br />
in the meane tyme which said offer the saide<br />
Vivian accepted, and at the petition of the said<br />
Smith the Judges did decree the said shipp to be<br />
appraised as she was at the tyme of the arrest<br />
thereof in this behalf made by the said Vivian by<br />
Commissioners to be named on both sides, and the<br />
said Crandley and Throgmorton did then<br />
likewise promise and undertake that upon payment<br />
by the said Tiddiman unto them for the<br />
said 4th part of the said shippe after the rate<br />
of Twoe thousand and twoe hundred poundes<br />
as he bought the same, they will secure him from<br />
all arrests suites, troubles and molestations<br />
whatsoever which shall at any tyme hereafter<br />
happen or be brought against him touching the<br />
said part which the said Tiddiman being then<br />
