a wittnesse sworne and examined<br />
saith and deposeth as followeth videlicet./
To the first article of the sayd allegation hee saith that hee being<br />
an Inhabitant of Yarmouth and a neere neighbour to the producents<br />
and seeing the shipp the ''Phenix'' while shee was in building and being<br />
present when shee was first launched thereby knoweth that the sayd shipp<br />
was originally built at Yarmouth, and and (sic) remembreth shee was soe built there in the yeare one thousand sixe<br />
hundred fifty sixe and for Accompt and by the order of the sayd<br />
Thomas Wilde William Scapes Richard huntington James Cheney<br />
and Christopher Greene all Merchants of Yarmouth and subiects<br />
of this Commonwealth who ever since her first building have bin and<br />
are Commonly reputed the lawfull owners of her, and this deponent<br />
knoweth that the sayd Wilde and Scapes, huntington, Cheney and<br />
Greene have as Owners of her fitted her out for severall voyages<br />
to Newcastle and Sunderland to lade Coales<br />
for their Accompt, and have upon her returne disposed of<br />
and sold such her ladeing as owners alsoe thereof, And hee<br />
saith that ever since the building of the sayd shipp the same hath<br />
belonged to the Port of Yarmouth, and further to this article hee<br />
cannot depose./
To the second hee saith hee being a neere neighbour as aforesayd<br />
knoweth and sawe that the sayd shipp ''Phenix'' was in the moneth<br />
of July instant one thousand six hundred fifty seaven sett out by<br />
