the sayd men of warr prizoners to the Groy … the sayd men of warr prizoners to the Groyne but saith hee<br />
sawe not any of the wines laden aboard the ''Mary and Joyce'' taken<br />
out of her and put aboard the ''Elizabeth'' arlate for that after some<br />
few dayes stay at the Groyne hee this deponent and the Master and divers of the<br />
Company of the ''Mary and Joyce'' got passage from the Groyne for<br />
ffrance yet beleeveth that the sayd forty pipes soe laden by the sayd<br />
herrera aboard the ''Mary and Joyce'' (or the greatest part of them) togeather<br />
with the rest of the wynes aboard the ''Mary and Joyce'' at her seizure (or<br />
the greatest part of them) were afterwards laden aboard the arlate shipp<br />
the ''Elizabeth'' and shee with the wines aboard her seized by some<br />
shipp in the service of this Commonwealth and brought into the River<br />
of Thames where the wines aboard her were unladen out of her<br />
into lighters and carried ashoare (and that as hee beleeveth by order<br />
of this Court) for that after hee came home to Plymouth from ffrance<br />
hee this deponent having notice that a shipp with sych wines aboard<br />
her as were formerly laden aboard the ''Mary and Joyce'' was then<br />
there, did goe aboard the sayd shipp ''Elizabeth''<br />
at Plymouth and came for Gravesend in the sayd shipp, and at<br />
her coming into the River of Thames went aboard her and there<br />
sawe in the sayd shipp and the lighters that were unladeing her many<br />
pipes of wine with the same markes upon them as those laden<br />
aboard the ''Mary and Joyce'' at Oratava And at the tyme of their<br />
ladeing aboard her there, and among others divers of them hee<br />
well remembreth were marked with the same markes mentio=<br />
ned in the sixth article of this allegation and hee verily beleeveth<br />
that they were the same pipes of wine soe laden at Oratava aboard<br />
the ''Mary and Joyce'' by the sayd Symon da herrera Leyva And<br />
further to these articles hee cannot depose./
To the last hee saith heis foregeoing deposition is true/
To the Interrogatories on the behalfe of his highnes<br />
the Lord Protector./ [CENTRE HEADING]
To the first Interrogatorie hee saith hee was only Supracargo of the ''Mary''<br />
''and Joyce'' the voyage in question and hath noe manner of Interest<br />
in the wines claymed by Antonio Rodrigues Robles And saith<br />
hee this deponent is a subiect of this Commonwealth borne at Limpston<br />
in devonsheire And further cannot answere otherwise than<br />
negatively./
To the 2 hee saith hee hath knowne the Interrogate Antonio Rodrigues<br />
Robles for these two yeares last or thereabouts as often seeing him<br />
frequent the Exchange London as a Merchant there And further to this<br />
Interrogatorie hee cannot answere./
To the 3 hee cannot answere knowing nothing touching the contents<br />
thereof./
To the 4th hee saith hee can give noe other reason in answere to the contents<br />
