Transcription The first of November <u>1653.</uThe first of November <u>1653.</u> Examined upon the allegation on the behalfe of the State<br /> given in this cause the 7th of October last past. '''5.''' '''Robert Kilvert''' of London Merchant aged 67. yeares or<br /> thereabouts sworne and examined saith and deposeth as<br /> followeth videlicet. To the first article of the said allegation hee saith and deposeth that<br /> the exportation of any plate and Bullion from any parts and places<br /> in the Kingdome of Spaine is absolutely forbidden by the Lawes<br /> of that Countrey and noe man may lade and export any without<br /> especiall License for the same, and whatsoever parcells shalbe found<br /> laden without License shall be lyable to confiscation which hee knoweth<br /> having as a Merchant lived 20. yeares in that Countrey ended<br /> about 27. yeares since, and having ever since traded thither<br /> and being by that meanes well acquainted with the Customess and<br /> lawes of that Countrey in the matter of ladeing of silver and plate<br /> and saith that hee this deponent hath knowne when many parcells<br /> of silver have bin seized and apprehended in the parts and Ports of<br /> Spaine within theise 40 yeares last past, and that such parcells have<br /> bin condemned for confiscate but doth not know that any person<br /> did suffer death for the crime of exporting his owne money And<br /> further cannot depose To the second and third articles hee saith and deposeth that for the discovery<br /> of those which export plate without License the Judges in Spaine<br /> search Merchants Bookes and writeings and Closetts, and doe alsoe<br /> search many shipps that are ready to sett saile to find out the bills<br /> of ladeing in the Pursers bookes, which may discover the offenders in<br /> this kind, and for prevention in these cases many Merchants put into<br /> the Bills of Ladeing the Laders by feigned and unknowne names, and<br /> many make Bills of Ladeing with blanck as to the names of the<br /> Laders, but the contents of the plate laden and the parties to whome<br /> consigned is usually plainely expressed. And this hee knoweth for the<br /> reasons aforesaid. And further cannot depose To the fourth hee saith that hee this deponent cannot particularly<br /> expresse any parcells of plate to be laden and exported from Spaine for<br /> the accompt of hollanders, but it is generally beleeved that they doe<br /> export good store as well as the Merchants of other nations And<br /> further cannot depose To the 5. hee saith that hee this deponent doth not knowe of any such<br /> colourable bills of ladeing to be made for the securing and redeeming<br /> of any such Goodes from danger, though it hath bin usuall and accompted<br /> iust and right soe to doe. And further deposeth not To the 6, hee saith hee cannot affirme any thing to this article more<br /> then the generall opinion and receiving in holland when by this or<br /> any other meanes they have escaped a danger, And further cannot depose To the 7th hee saith hee cannot depose./ Repeated before doctors Clark and Godolphin.
