To the 5th article hee saith it is not the … To the 5th article hee saith it is not the custome for lytermen to take<br />
charge of any Merchants goods but those that lade it are to take care of<br />
it and send som body to see the same safely delivered, the lightermen being<br />
not hyred to watch the same (if they bee any accident hindered) nor<br />
to make good any damage happening thereto (if it happen not by<br />
any insufficiency or rottenesse of the lighter) for that the freight<br />
of any lighter cannot bee nor is a thing soe considerable as to binde<br />
the lyterman or owners thereof to make good any damages happening<br />
to Merchandize And further hee cannot answere. not being<br />
imployed in the sayd lyter./

aged 32 yeares or thereabouts a witnes sworne and examined<br />
saith and deposeth as followeth videlicet./
To the first second third 4th and 5th articles of the allegation hee saith that hee<br />
well knoweth that hee this deponent was Commanded by his master Mr Ambrose<br />
Pomery to goe with a Close lyter of the sayd Mr Pomereys to Blackwall to the<br />
shipp the ''Smyrna ffactor'' and to take alonge with him in the lyter a servant of the<br />
arlate Captaine hudsons, which servant (as hee told this deponent) had order<br />
from the sayd Captaine hudson to his Mate and Company that they should<br />
give over ladeing of the open lyter they were in hand with and presently lade<br />
the sayd cloase lyter, and this deponent accordingly went with the sayd Cloase<br />
lyter and the sayd Captaine hudsons servant in her and commeing to the shipp<br />
''Smyrna ffactor'' then lying at Blackwall the sayd hudsons servant went<br />
aboard the sayd shipp and (as this deponent beleeveth delivered a message<br />
to some of the sayd shipps companye to the effect aforesayd, whereupon some<br />
of the sayd shipps Company spake to the lytermen of an open<br />
lyter which lay by the shipps side about halfe loaded with Cotton woolls (videlicet the lyter wherein the damage in controversie afterwards happened)<br />
and bid them vere their open lighter back towards the sterne of the sayd<br />
shipp which the sayd Lytermen were unwilling to doe and desyred they might<br />
have their whole ladeing that they might be gone therewith the next tyde wgereto<br />
