in the East London Lighterman aged 29 yeares or<br />
thereabouts a witness sworne and examined saith and<br />
deposeth as followeth videlicet./
To the first second third and 4th articles of the sayd allegation hee<br />
saith and deposeth that by reason hee this deponent and one William<br />
Purse were the persons who were the lightermen and had the management<br />
of the lyter in which the damage in question happened hee well knoweth that<br />
the sayd Lyter was an open lyter and that hee this deponent brought the<br />
same Lyter and layed her close by the side of the shipp the ''Smirna ffactor''<br />
arlate then rideing over against Blackwall Stayres upon a Satterday morning where shee laye till the Monday morning next following for that the Shipps company would not worke on Satterday in the afternoone and upon Monday morning<br />
(what moneth or day of the moneth hee cannot at present call to mynde) the<br />
Company of the sayd shipp presently fell to worke and about halfe laded<br />
the sayd open lighter, and hee this deponent and the sayd Purse were willing<br />
and ready to have received the whole ladeing of the sayd open lighter on board<br />
her and to have carried the same to London of the arlate Captaine hudson<br />
or his mate and the sayd shipps Company would have fully laded her<br />
which this deponent beleeveth they might have done if they haad pleased<br />
And this deponent and the sayd Purse were resolved in case they could have gotten the sayd Shipps Company to have delivered unto them the sayd open lighters<br />
full ladeing they would have gone with the same for London and carried the same<br />
to Galley Key there (the place they were appointed to unlade at) the next fludd<br />
But saith that about two or three of the clock in the afternoone of the monday<br />
aforesayd there came a Cloase lyter which as afterwards appeared was<br />
sent by the sayd Captaine hudson to take in a ladeing of fine goods from<br />
on board the sayd ''Smirna ffactor'' and this deponent heard one Gilbert<br />
Woodman who had the care and mannagement of the sayd Cloase lighter and<br />
was Lyterman thereof, saye that Captaine hudson aforesayd had sent<br />
his men (whome this deponent then sawe come in the sayd Cloase lighter)<br />
to give order to his the sayd same mate then onboard that hee and the sayd shipps<br />
Company should desist and give over the further ladeing of the sayd open<br />
lighter and presently fall in hand with ladeing the sayd Cloase lighter<br />
whereupon the sayd Mate called to this deponent and comanded him to vere<br />
his sayd open lighter and fall a sterne to make waye for the sayd Cloase<br />
lighter to lye in the open lighters place to take in her ladeing and this<br />
