and bill for the said nine chests, and shortly after the said Ba[XX] sent<br />
over in a letter from Amsterdam to this deponent the attestation or examination<br />
of the interrogated Man[?u]el Lopez Aug[XXXtio] captaine of the said Portugall shipp<br />
[XXX the said XXXXXX] which this deponent alsoe produced and caused to be exhibited into this Court,<br />
being the attestation interrogated: And saith that hee this deponent hath [?received]<br />
severall letters from his said brother advising him that hee had 20 chests of<br />
sugars laden in the said shipp for his accompt, and desiring him to<br />
doe his best endeavour for the recovery thereof by claiming of the same<br />
advising him withall, that they pr[?ovided] of certaine goods sent<br />
by the said Man[?nel] [?lopez] Aug[?uito] to [?Angola] and consigned to him the<br />
said Auguisio for the said John Bushells accompt, or to the very same<br />
effect, And otherwise hee cannot depose.

To the first hee saith that hee doth not knowe of any share that hee this<br />
examinate hath in the sugars interrogated, and saith the said John Bushell hath<br />
advised this examinate that the said 2[?9][?caske] of sugars were for his owne<br />
proper accompt, and hee conceiveth that the [XXXXXing] of mentioning him and<br />
company in the bill of lading is, that in case of his absence such person<br />
or persons as [XXXX] shall [?leave] to manage his busines and recover in his<br />
adventures, may receive the same for him, and hee doth not beleeve that<br />
any Portuguese or any subiect of the kinge of Portugall hath any interest<br />
at all in the said twenty chests of sugars, but that they all really<br />
belonge to his said brother./..
To the second hee saith that the said [XXXX] alsoe advised this deponent<br />
that when the said Captaine had acknowledged the having the said chests<br />
of sugar aboard, and hee the said Barr asking him if hee had any bill of<br />
lading from the [XXXX], the said Captaine answered him that hee had a<br />
bill of lading for the same and would bring it unto him, which hee saith<br />
hee did accordingly, and this deponent verily beleeveth the said bill<br />
to be reall and firm, and to be signed by the said Captaine, who was<br />
not only master of the shipp, but alsoe the merchant imployed by<br />
the said John Bushell in the buying and lading of the said sugars.<br />
And otherwise saving his foregoeing deposition hee cannot answ[?a]r or depose.
To the third and fourth hee saith that hee received noe Invoyce or factori[?a] for the<br />
said [XXXX] of sugars, and otherwise hee cannot depose saving his<br />
foregoeing deposition.
To the fifth hee saith that [XXX] only English men residinge in Portugall<br />
but the people of any other nation there dwelling may ffreely trade<br />
in Brazilia and this deponent when hee lived at Lisbone<br />
did himselfe trade to Brazila, and since hee hath continually<br />
traded there for theise seaven or eight yeares by his factors, Amd<br />
otherwise hee cannot depose, saving as a foresaid.
