Ad primum et secundum arlas dicta allegaconis deponit et dicit that<br />
hee this deponent being second Mate to Captaine Edmond Ellison<br />
aboard the ship the [?''Pearry''] att such tyme as the said ship was lost<br />
to and taken by the ffrench as is hereafter expressed And saith<br />
that soe soone as the ship the ''Great Alexandria'' arlate was<br />
espied to bee a man of warre and (by her Giveing the ''Pearcy''<br />
chase for a day and a night tyme together) was likely[?e] to fall upon<br />
the said ship, hee this deponent together with<br />
the producent Symon Bayly and diverse others of the said<br />
shipp the [?''Perrys''] Company did earnestly desire and importune<br />
the said Captaine Ellison that they might watch [?theire] opportunity<br />
and soe fire theire great Gunnes att her soe soone as the<br />
said ffrench man of warre came within the Comand of theire Gunnes<br />
telling him that thereby they might in all likelyhood shoot the<br />
Masts or yards of the said Man of warre a sunder and soe disable<br />
and prevent her from boarding the said ship the ''Perry'', but the<br />
said Captaine Ellison as hee saith would not by any meanes<br />
permitt them soe to doe telling them that the said ship the<br />
''Alexandria'' was one of the King of France his ships and that he would<br />
not fire first at her least thereby hee should bee guilty of the breach<br />
of the peace betweene the two Nations, but did suffer the said shippe<br />
to come very neare unto them with her head a little asterne of<br />
the said shippe the ''Pearry'' and then being againe requested<br />
by the said Symon Bayly this deponent and others of the said shipps<br />
Company, that they might [?turne] the said shipp the ''Pearry'' and<br />
bring her broad side upon the head of the ''Alexandria'' and<br />
lay her thwart the hawse and then lett fly her great gunnes<br />
att her on the whole broad side which hee saith would have raked<br />
the said ship fore and aft and soe have distroyed many of theire<br />
enemies they being upon the decks of the said man of warre in<br />
great abundance and nombers. but the said Captaine Ellison<br />
would not permitt this to be done neither, either of which<br />
courses, if the said Captaine Wllison would have condescended<br />
unto this deponent saith hee is very confident would have<br />
prevented the said ffrench man of warre from boarding the<br />
said shipp the ''Pearry'' as afterwards shee did, and soe the<br />
