right worshipfull John Exton Doctor of Lawes<br />
one of the Judges of the highe Court<br />
of Admiralty and examined upon Interrogatories<br />
ministred on the behalfe of the said Perrot Avery<br />
and Dyet touching the losse and delivering up<br />
of the shipp the ''Pearrt'' to the ffrench. saith<br />
by vertue of his oath as followeth. videlicet./.
To the first and second Interrogatories ministred on the behalfe<br />
of the above mentioned producents this deponent saith<br />
and deposeth, that hee this deponent being cheife Mate<br />
about the Shippe the ''Pearry'' all the last voyage which<br />
shee made from this Port of London to Blewett in Brettany<br />
and soe to severall other Ports and Places beyond the<br />
Seas and untill shee was taken by the ffrench as is heere<br />
after expressed, did desire and earnestly importune<br />
Captaine Edmund Ellison the then Master of her that<br />
they (being chased by a ffrench man of warre off<br />
the Ilands of Ayris about 30 leagues distance by the<br />
space of eighteene howers together and seeing the said<br />
Man of Warre to come still nearer and nearer unto<br />
them) might fire the great Gunns of the said ship<br />
the ''Pearry'' att her att such tyme as the said ffrench<br />
man of warre came within command thereof (hee this<br />
deponent perceaveing her to bee a Man of warre and<br />
by such messages as the Comander thereof<br />
sent by his Lewetenant in his boate, thereby demanding<br />
the said Captaine Ellison to come aboard theire said shippe<br />
and give him an Accompt of what papers or Charterparties<br />
