Transcription porrected a premium decretum in writinge wporrected a premium decretum in writinge which<br /> the Judges at his petition in paine et cetera each beinge<br /> made by him of the truth of the contents thereof<br /> accordinge to the information to him given which hee<br /> beleeveth to bee not admitted and decreed as in<br /> the same is contained Then the said Smith in paine<br /> et cetera porrected a bill of expences in writing which<br /> the Judges did tax at the summe of six pounds and<br /> tenne shillings and Smith made oath that his<br /> clients have expended and are to expend the said<br /> summe./ Ralph Stubb late owner of one}<br /> eighth parte of the shippe the}<br /> ''Scout'' against William Standen}<br /> Colequite} Which day appeared the said<br /> Colequite for the said<br /> Stubb and made himselfe<br /> partie for him and alleadged<br /> that William Standen and Company<br /> owners of seaven eight parts of the<br /> said shippe the ''Scout'' beinge long since<br /> resolved to sett forth the said shippe upon a<br /> voyage to sea did cause the said Stubb to bee<br /> cited to appeare to contribute his proportionable<br /> parte of the charges in setting forth the said shippe or<br /> els to show cause why the said shippe should not<br /> bee repaired and sett to Sea att their owne charges<br /> whoe not appearinge att the time prefixed nor by<br /> himselfe or his proctor showinge any cause why the<br /> said shippe should not bee repayred and sett to sea<br /> att the charge of the said Standen and Company<br /> The Court thereupon did order and decree the said<br /> shipp to bee repaired and sett to Sea att the proper <br /> costs and charges of the said Standen and Company<br /> they first giving securitie to the effect in the like<br /> cases usuall And thereupon Mr Suckley proctor for<br /> and on the behalfe of the said Stanon and William<br /> Drakeford upon the second day of June 1654 produced<br /> twoe sureties whoe became bound for the said<br /> Standen and Drakeford in the summe of ffifty pounds<br /> of lawfull money of England to the said Ralph Stubbs to<br /> returne the said 8th parte of the said shipp the ''Scout''<br /> into the River of Thames within twelve monthes and<br /> to submitt the same to the arrest of this Court or to<br /> pay the value of the same accordinge to the appointment<br /> thereof taken by authority of this Court in case the<br /> same shall in the meane time miscarry or be cast away<br /> Now forasmuch as the said twelve monthes are longe<br /> since elapsed and the said shippe not returned as<br /> aforesaid The Court at the petition of the said<br /> Colequite did condemne the said Standon in the<br /> value of the said eighth parte of the said shippe the<br /> Scout accordinge to the said appointment amounting to<br /> the summe of 19 ''li'' 7 ''s'' 3 ''d'' to the said Ralph Stubb and<br /> decreed him to bee monished to pay the same within<br /> fourteene after daies after monition./.
