Which day the said ffrancklin<br />
appeared for the said Davies<br />
Mitchell and Company and<br />
made himselfe partie for<br />
them and [?Faine] an allegation<br />
in writing which the Judges admitted<br />
soe farre as the same is by lawe<br />
admissible Then the said ffrancklin uppon<br />
the said allegation produced the said [?William]<br />
Vincent as a party principall whom the Judges<br />
receaved and administred an oath unto him to<br />
speake the truth at the time of his answeareinge and<br />
monished him to give in the same by wednesday<br />

lawe to have any wages for their service in the<br />
said shippe the ''Tankervaile'' the voyage in question and<br />
that the said Batson and Company ought to bee<br />
dismissed from any further observation of Judgement<br />
in this busines and did absolve and dismisse them<br />
from the demannds made by the said Cooke and<br />
Janson by this suite the said Clements dissentinge<br />
et cetera and protesting of the nullity and greivance and<br />
of appealinge./.

behalfe of the Commissioners for<br />
examination of witnesses did<br />
present their [?proces] upon the examination<br />

[?Grabble] and Greenefeild which the proctors on<br />
both sides did accept soe farre forth as they make<br />
for them and not otherwise And then the Judges at<br />
Smiths petition did decree publication of the said depositions<br />
and decreed copies thereof Suckley dissentinge./.

absence of Mr Budd appeared for the<br />
said Warner and made himselfe partie for<br />
him and exhibited the originall mandate with the<br />
certificate thereon indorsed and then appeared the<br />
said Watson whome the Judges monished to give a full<br />
and plaine answeare to all the articles of the libell given<br />
against him in this cause and monished him to putt in the<br />
