voyage she was an old shipp which soe generally looked upon to bee, And the<br />
upper worke he saith was untrimed and unrepaired and the pumpes of the shipp<br />
were not fitted as they should have bin for such a voyage and by reason<br />
of such defects of the said shipp and a great storme happening neere the<br />
Northerne Cape the foresaid goods received dammage by reason<br />
of the waters comming into the said shipp and running into the hold. Et<br />
alr nescit.
Ad 4 rendet et deponit that in case the said shipp had bin fitted as she ought to have<br />
bin for such a voyage, in her upper workes and pumpes hee beleeveth<br />
in his Conscience that the goods would not have received soe much<br />
dammage as they did. And it is possible hee saith that the goods<br />
might have bin damnified by the fore said storme had the shipp bin a<br />
tight and substantiall shipp, et alr nescit.
Ad 5 rendet et deponit that hee helped to land y:e said lading of<br />
Pilchards at Leghorne, and did see and know that severall of the Caskes<br />
of the said goods were damnifyed by water running into or amongst them, which were chiefly occasioned by reason the shipp<br />
was defective in her upper workes and pumpes and thereby unable to beare<br />
a storme soe well as a stronger shipp. Et alre nescit

yoyage she soe began on about the 20:th of December last and came to<br />
an anchor over against Bell wharfe staires in lower Shadwell about six weekes since. And saith the said shipp went from Plymouth with a lading of<br />
