Ad primum rendet that the said Arnold and Elias Beake did not in any of their<br />
letters of Orders about the freighting a ship for the goods in question mention the said ship ''ffortune''<br />
and saith that they sent the said letters at the time of the dates by the post to the said Samuel Beake<br />
at Bourdeaux and this deponent just before they were sent away copyed them<br />
in the Copy book of the said Mr Beake, out of which hee tooke<br />
notes (which hee hath now with him) of the tenour aforesaid, et<br />
alr salvis predepoita ad qua se refert nescit.
Ad 2um rendet That hee knoweth not the rest of the said goods but by the<br />
Invoyces to which he referreth which Invoyces were sent over by the said<br />
Samuel Beakes to the said Claimers, but when they received them hee<br />
knoweth not nor knoweth whether any money or any thing els is<br />
paidd for or in part of the goods now claimed. et alr nescit
Ad 3um rendet That the said Mr Beakes use severall markes<br />
but the particular markes hee cannot put downe And saith that the<br />
said Mr Arnold Beake is this rendents uncle and hee is their clerke as aforesaid<br />
and is not otherwise related to them, and sayth that hee hath noe interest in the<br />
goods claimed, and is worth fourty pounds in cleare estate as hee beleeveth<br />

Examined on behalfe of his Majesty in<br />
[?praeparco] saith and deposeth
That hee was one of the Company of the ''Assurance ffrigott'' John Norborow Commander<br />
and hath soe bin mate of her, and Mitshiap (sic) man for about five monthes last<br />
And saith the said ffrigott being by the Generalls sent out to front while<br />
the English ffleete lay at Sole bay, and being upon the Scout on or about<br />
the thirteenth of August last past discovered three vessells under<br />
saile and making up to the shipp in question discovered her to have<br />
dutch colour up and hee by eleaven of the clock toward noone comming soe no one as to discerne the ffrigott to bee<br />
an Engish ffrigott, boore away before the wind making all the saile hee<br />
possibly could which the Commander of the saidd ffrigott Perceiving made also<br />
after them and on or about one or two of the Clock in the afternoone of the same day<br />
seized and tooke the ''Seaven Starrs'' arlate being laden with wine and<br />
Brandy as the Company affirmed, bound for Holland and having eleaven<br />
Gunns on board. And saith that after and before the said ffrigott<br />
came up with her the said prize she fired severall gunns at the ffrigott<br />
namely one of the shotts tooke place in the main mast, another in the<br />
maine topmast, which much damnifyed the masts and severall other<br />
Shotts before she gave and received before shee would yeild<br />
And saith severall of the said Shipps Company declared that they came from<br />
ffrance and were bound for Holland, and that the said shipp and lading consisting<br />
of wine and brandy belonged to Hollanders also. Et alr nescit saving the Master refusing to yeild<br />
was by one of the ''Assurances'' Company killed, whereupon they presently yeilded
