Ad jum positionem dictj Libell dicit et deponit that in the<br />
moneth of September and October 1658 the lilate Robert<br />
Merriat Nicholas Bradley and Company were the true<br />
and reall Owners of the lilate ship the ''John'' of Ipswich<br />
and her tackle and furniture and alsoe of about One<br />
hundred and fforty Chaldron of Coles thenonboard her And<br />
for such they were commonly accounted, which hee knoweth<br />
going in her the voyage in question et alr nescit./.
Ad secundam positionam dicit et deponit that for and during<br />
all the months aforesaid the lilate John Cole was master of<br />
the lilate ship the ''Mary Rose'' and had the care and<br />
Charge of her as Master and for such commonly Accounted
Ad 3rd 4th 5th et 6um positione dicit that in the said month of October<br />
1658 (the particular Day hee cannot call to minde) the said<br />
ship the ''John'' was comming out from the river of Newcastle, and had then onboard<br />
her the number of One hundred and ffourty Chaldrons<br />
of Newcastle Coales Newcastle measure, and shee was soe<br />
coming out in company with a great ffleete of shipps, the<br />
greatest part of which were a head of the ''John'', and the winde<br />
being then West South West, or neere thereabouts, the foresaid<br />
Robert Marriot the Master of the ''John'', to prevent Coming foule<br />
of some or one of the ships of the said ffleete ahead of<br />
the ''John'' as aforesaid did Cause the Topsaile of the ''John''<br />
to be lowered and if the same had not bin done the ''John''<br />
would undoubtedly have come foule on some or one of the<br />
foresaid Ships, And saith that soone after the ''John'' weighed<br />
Anchor in Tinmouth haven the said time, the Company<br />
of the ''Mary Rose'' alsoe weighed, to come out thence<br />
and came asterne of the ''John'' untill shee came onboard<br />
the ''John'' and did the dammage hereafter mentioned, And<br />
the said Robert Marriot seeing her come neere to the<br />
''John'' (the ''Mary rose'' having all her sailes full, and her<br />
boate Towing of her,) called out to the said John Cole<br />
the Master of the ''Mary Rose'' and desired him for [?XXX GUTTER]<br />
sake to shorten saile for feare hee should be onboard<br />
