at Sea, this Deponent and the said Captain … at Sea, this Deponent and the said Captaine Bun<br />
acquainted the said Captaine Whetstone therewith and delivered<br />
to him what papers they had then found; and saith that<br />
the next day the said Winter went onboard the said<br />
Prize and turned this Deponents and the said Captaine Buns<br />
Men out of her, and they coming onboard (acquainting<br />
this Deponent and the said Captaine Bun therewith<br />
this Deponent and the said Bun<br />
went on board the said Prize to knowe wherefore hee<br />
Turned their men out, (it being contrary to the Custome of<br />
the sea) and at their comming onboard hee saith they<br />
found the said Winter. together with the Company which hee<br />
brought onboard, breakeing open the hold of the said Ship<br />
and taking out, and sending severall bales of goods aboard<br />
the ''ffairfax'', and the said Winter abused severall of the Dutchmen that were on board the said Prize and tooke away the Cloathes<br />
belonging to a Genoes merchant who was taken in the said Ship,<br />
which were very good, and rich and were worth as this Deponent verily<br />
beleeveth two hundred pounds Sterling at the least, and<br />
never restored them to him againe, and the said Merchant<br />
declared to this Deponent that the said Winter tooke out of<br />
his truncke three hundred Spanish peeces of Eight<br />
and this Deponent and the said Captain Bun seeing the said<br />
Winter and Company breaking open the hold plundering and<br />
taking away the Goods onto the said Prize, and cating<br />
soe Contrary to the foresaid Lawes and Customes of the<br />
sea. went on board their ffrigotts. and saith<br />
that when the said Winter turned this Deponents and the said<br />
Captaine Buns men out of the said Prize, her Bulke was<br />
not broken, nor any goods whatsoever taken out of her neither<br />
from betwixt Decks or out of hould,<br />
And further saith<br />
that the said Prize was caried by the said Winter and<br />
the Company hee carried on board her, to the Road of<br />
Marsellis, the ''ffairefax'' and the other ffrigotts goeing alsoe thither<br />
where the said Prize was wholly unloaden, and some of<br />
the lading was sold at Marsellis, and some sent in the ''Little''<br />
''Lewis'' (which then lay there) for Genoa, and this Deponent being<br />
there on shore was credibly informed by two English merchants<br />
namely mr Land and mr Wallis, that the Company of the said<br />
