''Rose'' aged 41 yeeres or thereabouts [?sworne]<br />
And examined
To the first and second articles of the said Allegation hee<br />
Saith that about a yeere since the time hee doth not<br />
otherwise remember the ships the ''John and Mary''<br />
''Rose'' arlate did ride at Anchor with their lading of<br />
Coales on board them in Tinmouth Haven, and [?four]<br />
other ships lay then in the said Haven round [about]<br />
the said ships ''John and Mary Rose'', and many of them<br />
did weigh Anchor And set saile out of the [XX]<br />
Haven the same morning that the ''John and Mary''<br />
''Rose'' weighed Anchor And saith that presently<br />
after the ''Mary Rose''. Her Anchor were weighed [her]<br />
Master called to the Company of the ''John'' Hee lying a<br />
little a head of the ''Mary Rose'', and desired them<br />
not to weigh their Anchor (which they were then [?doeing]<br />
Until the ''Mary Rose'' was shott by her, or to that [?effect]<br />
but notwith standing the Company of the ''John'' did<br />
weigh her Anchor and sailed direct a head of the ''Mary''<br />
''Rose'' and after shee had soe sailed a little [spXXX]<br />
the ''John'' fetched a sheere over to the south on<br />
the south shore and the ''Mary Rose'' sailed directly<br />
forward, and as she was soe saileing the said [?ship]<br />
''John'' came sheereing from the south ward age[?ing]<br />
toward the Northward and came foule of the ''Mary''<br />
''Rose'', and ranne her foreshroud upon the [?XXX XXXX]<br />
of the ''Mary Rose'', and her Lanyeard of her maine<br />
was [?Catched] by the flooke of one of the [chich?] of the<br />
''Mary Rose'', All which hee saith came by reason of [?the]<br />
''Johns'' sheering as aforesaid and not by any [fault Gutter]<br />
of the Master and Company of the ''Mary Rose'' which hee<br />
knoweth being Carpenter of and aboard the said<br />
Ship ''Mary Rose'', and an Eyewitnes of the [PXXX]<br />
and further cannot depose.
To the 3rd. 4th and 5th hee saith that when the said ship ''John''<br />
did come foule of the ''Mary Rose'' as a foresaid<br />
Boate of the ''mary Rosse'' did not towe her, nor did [XXX]<br />
Untill shee was Cleere of the ''John'' And saith [?that]<br />
the master and Company of the ''Mary Rose'' seeing the<br />
''John'' come sheering from the Southward as aforesaid<br />
