of sugar and upwards, a great quantity of Shumack and some<br />
rowles of Tobaccoes (this deponent at present not remembring the<br />
certaine quantities of each sort of the said goods) for the use<br />
accompt and behoofe of him the said Antonio fernandez Cara[?vaiall]<br />
and that the said Policarpio did shipp or cause the same to be<br />
Laden and putt on board the said shipp the ''New England''<br />
''Merchant'' for the accompt aforesaid, and did consigne them to<br />
be delivered at Roan in ffrance unto the said Antonio Rodrigues<br />
de Morais, and Jeronimo and Raphael Rodrigues Lamego<br />
for the behoofe and accompt of him the said fernandez. Of and<br />
concerning the reality and trueth of the premisses this deponent saieth<br />
he is fully convinced and assured, and rendring a reason of such<br />
his assurance saieth, That hee this deponent in the quality of<br />
Assistant to the said fernandez in his negotiation as aforesaid<br />
hath both seene and perused the said Policarpios letter or letters<br />
of asvise written (before his restraint) unto the said fernandez<br />
concerning his said Lading of sugars, shumack and Tobaccoes<br />
for and with the proceed, and moneys or effects soe ordered<br />
as aforesaid, and to and for such accompt, and with such order and<br />
consignation, as is above expressed, And for that this deponent hath<br />
likewise seene and perused a letter of Advise sent by the Master<br />
of the said shipp from Porto Porto aforesaid to the said<br />
Mr ffernandez importing and implyeing the Lading of the<br />
said sugars shumack and Tobaccoes<br />
upon the Consignement and designe before mentioned. And<br />
further to this Article hee deposeth not,/:.
To the seaventh Article hee saieth That it is a matter and<br />
transaction publique and notorious, That the said shipp having<br />
received on board her her said Lading of sugars, shumacke and<br />
Tobaccoe, the said goods were all seized upon by the Officers of the<br />
Inquisition at Porto Porto aforesaid or other Ministers and<br />
Officers of the king of Portugall in that place, and that [?under]<br />
the notion of, and as being goods said to belong to the said<br />
Policarpio de Oliveira, and were there brought on shoare<br />
and not permitted to proceed for france according to th[XX] [?dXXXX]<br />
but are there detained and kept to the great prejudice and<br />
