the sayd William Warren And saith the sayd … the sayd William Warren And saith the sayd hundred and<br />
nynty pipes of wyne at their ladeing aboard the sayd shipp were<br />
marked severally, videlicet a hundred and eighty of them with the first<br />
marke in the margent of the bill of ladeing to the allegation annexed<br />
And the other tenn were marked with the second marke in the margent<br />
of the sayd bill And having perused the bill of ladeing to the allegation<br />
annexed and the firme or subscription thereof hee saith the same is one of the [?two GUTTER]<br />
bills of ladeing by him soe sugned for the sayd hundred and nynty<br />
pipes of wyne and the [?wax] therein specified, and the firme or signing<br />
therof is his this deponents owne hand writeing And the sayd<br />
bill of ladeing hee saith is a reall and true bill of ladeing and not<br />
Colourable And hee further saith that the sayd one hundred<br />
fiftie pipes of wine parcell of the sayd one hundred and nynty<br />
pipes were really laden and put aboard the sayd shipp for the<br />
proper Accompt of the sayd Thomas Warren and (as hee beleeveth<br />
with the proper goods and effects of the sayd Thomas and hee beleeveth<br />
that noe person save the sayd Thomas had or hath any interest in<br />
the sayd hundred and fifty pipes of wyne And further to those<br />
articles hee cannot depose/
To the 8th article of the sayd alleagtion hee saith that the sayd<br />
hundred and nyntie pipes of wine being at the Canaries soe<br />
laden aboard the ''Mary and Joyce'' shee therewith, and with other<br />
goods of the sayd Thomas Warren (beside the sayd 150 pipes of<br />
wyne) as waxe and other Merchandizes to a very considerable<br />
value departed from Oratava arlate bound for the Port of<br />
London and in her course thitherwards was with all her sayd lading<br />
of wynes and other goods seized by two frigotts or shipps or warr<br />
Commissionated (as their Captaines and Companyes affirmed<br />
by the King of Spaine to seize the shipp and goods of the subiects<br />
of this Commonwealth of England which ffrigotts as their<br />
sayd Captaines and Companyes pretended and gave out belonged to<br />
dunkirke and Ostend arlate And hee saith the arlate Jacob<br />
Bolart was or at least gave him selfe out to bee Captaine<br />
of one of the sayd ffrigotts And the arlate John Van Sluce<br />
was or at least gave him selfe out to bee Captaine of the other<br />
of them which Captaines with their sayd shipps having<br />
soe seized the ''Mary and Joyce'' and her sayd ladeing carried them<br />
and it to the Groyne in Galisia arlate And further to this article hee<br />
cannot depose/
