the arlate William Croford and company did … the arlate William Croford and company did refuse to take them<br />
aboard for that they had taken in their full ladeing before they came And<br />
the sayd Croford told those of his shipps Crue who had brought those<br />
hogsheads from the sayd Bellingers storehouse (which as they sayd they<br />
brought by his earnest importunitie contrary to their owne desyne for that<br />
they knew the shipp to be fully laden before, and for that the sayd Bellinger<br />
as they sayd told them they should not goe away with their shallopp aboard<br />
the shipp without takeing those hogsheads of his with them) that hee could<br />
not take them aboard for the reason aforesayd and soe they remayned<br />
in the shallopp by the shipp side for two dayes and a night And then the sayd<br />
Bellinger came him selfe aboard the said shipp and asked the Company<br />
thereof why his goods were not taken aboard whereto they replyed that<br />
the shipp was fully laden before their comming and therefore they could not<br />
bee taken aboard her whereupon the sayd Bellinger desyred to speake with<br />
their Captaine, and the Captaine being called came upon the deck to<br />
the sayd Bellinger and the sayd Bellinger asked the sayd Captaine Croford<br />
in the presence of this deponent and his contest Jacob Ceeley and one John hobson<br />
and others of the shipps company wht the sayd eight<br />
hogsheads of sugar were not taken aboard And the sayd Croford in presence<br />
of the sayd persons and others of the shipps company answered that the sayd<br />
shipp was fully laden before they came and that shee had as many goods<br />
aboard as shee could well carrie, and that if hee should take any<br />
more goods aboard then what hee had before they came jee must bee<br />
forced if hee mett with stormie weather or Enemyes in his passage for<br />
England to heave them overboard and therefore desyred the sayd Bellinger<br />
not to put them aboard or to that effect which notwithstanding the sayd<br />
Bellinger told the sayd Croford that hee must needes take them aboard<br />
and should take them and that if they came to any dammage thereby hee<br />
the sayd Bellinger would bee contracted to beare the losse thereof or<br />
words to that effect This hee deposeth being present and hearing the same<br />
spoken And well knowing that the sayd shipp was fully laden before<br />
the sayd hogsheads came to be laden aboard her for that to satisfie<br />
the importunitie of the sayd Bellinger the sayd hogsheads being taken on<br />
board were faine to be stowed betweene decks in the gunne roome and<br />
bu the gunne roomes doore this hee knoweth for that hee helped alsoe to<br />
stowe them And further hee cannot depose/
To the 6th 7th and 8th articles of the sayd allegation hee saith that the sayd<br />
Croford and Company having (by the sayd Bellinger his importunitie<br />
and by reason of his promise to beare what losse should come to the sayd sugars<br />
thereby) taken aboard the sayd shipp the sayd eight hogsheads of sugar<br />
sett sayle therewith from the Barbados bound for London and in the sayd<br />
shipps course thither shee upon the twenty fowerth day of december one<br />
thousand sixe hundred fifty sixe in the night tyme mett with a very violent storme which<br />
continued with great furie that night and also on the 25th 26th and<br />
27th dayes in soe much that the shipps longe boate was staved lying upon her<br />
deck by the force of the sea beating over the shipp and the shipp and her ladeing<br />
and the shipp and her ladeing<br />
