proceede on with the delivery of the rest … proceede on with the delivery of the rest at the same rate but saith that
as this deponent and his contest and the rest hyred to unlade the sayd shipp were
comeing to proceede on in the delivery thereof the sayd John Bayly the master
of the ''Imployment'' met them by the way and desyred them to make
haste on board the sayd shipp and worke hard to deliver his ladeing for
that she was almost sunke and told them hee would goe to Billingsgate
and get men to helpe to [?XXX] the sayd shipp and preserve her from sinkeing, whereupon this deponent and
his contest and the rest soe hyred to unlade her went on board the sayd shipp
but at their comming found her very deepe of water in the hold and when
the Master returned on board with a great company of men that hee brought
with him to helpe to pumpe and bale the sayd shipp, this deponent and the rest
soe hyred to unlade her, told him that there was soe much water in the
shipp and the Coales were soe wett that it would much endanger their
lives to worke in the wett and water continually night and day till shee
were delivered as they must of necessitie doe, and that therefore they would
not worke at the rate of twelve shillings a man as formerly they
had agreed, whereupon the sayd John Bayly desyred them for Gods sake
to fall aworke upon delivery of the Coales and hee would give them
any content that was fitting, and soe came to a new agreement with
this deponent and the sayd other fifteene labourers and agreed to pay them
sixe and twenty shillings a man to deliver her sayd ladeing of Coales
and thereupon this deponent and the rest soe hyred fell to worke upon unlading
the sayd Coales and wrought naked in the water, soe to doe, and heaved them
out at the ports for hast into lighters prepared to receave them, wothout
measuring them aboard as is usuall and acustomed to bee done And the sayd John Bayley
did pay to this deponent and the other fifteene men soe hyred to unlade her
twenty three shillings a man for such their labour which was eight pounds sixteene shillings more then they first bargained for which hee this deponent
and the other fifteene men were contented to accepte of, though it were lesse
then what they last bargained for, in respecte of the great losse and
damage they sawe the sayd bayley was like to suffer, and
hee saith that of his this deponents sight and knowledge the sayd
Bayley had a great many men on board his sayd shipp (beside his owne
company) to helpe to pumpe and bayle water out of her severall tydes and
hee this deponent sawe him pay to divers of them halfe a Crowne a tyde
and observed that they were not well contented therewith
but grudged and thought it too little, but knoweth the summe hee paid
them amounted in all, hee knoweth not, And further to these articles
hee cannot depose, saving hee saith the shipp ''Imployment'' was neere
fully laden when the damage in question happened./
To the 17th 18th 19th and 20th hee cannot depose
To the 21th hee saith hee referreth himselfe to the Registrie of this Court and
further cannot depose/urt and
