referring him selfe to the Registry of this Court hee cannot depose
To the last hee saith his foregoeing deposition is true/
To the Interrogatories./ [CENTRE HEADING]
To first Interrogatorie hee saith hee cometh to testifie in this cause at the request of de haze<br />
and Stock the producents and is promised nothing nor expecteth any thing for his testimony<br />
and saith hee is Owner only of one ferkin of butter and his cloathes<br />
and Instruments which were aboard the ''Successe'' when shee sunke And saith hee was Master<br />
of her and standing neere the mayne mast of the ''Successe'' when shee receaved her<br />
sayd hurt which soone afterwards caused her to sinke./
To the second hee saith the first tyme hee sawe the shipp the ''dove'' Interrogate was when<br />
shee came sayling towards the ''Successe'' and ranne upon her at the Nell and<br />
then sanke her in manner predeposed and saith hee sawe her afterwards divers tymes<br />
in the River of Newcastle while shee laye there mending her bowe, and divers tymes since<br />
in the River of Thames but how oft at either place hee knoweth not, and saith hee knoweth the<br />
Interrogant Cable and hath knowne him only since the damage in question done videlicet since<br />
this deponent spake first with him about the same at Newcastle in the moneth of August<br />
last And further cannot answere./
To the 3 Interrogatorie hee saith the Nell is a place which lyeth in the direct course for New<br />
Castle and most shipps thither bound passe over it and the same is as hee guesseth it<br />
about seaven or eight leagues in length more or lesse, and saith when the damage prede=<br />
posed of was done which was about 2 of the clock in the norning of the 8th of August<br />
last it was soe light that this deponent and company could well discerne the shipp the<br />
''dove'' aforesayd a good while before shee came neere the vessell the ''Successe'' in soe<br />
much that this deponent had tyme to call up two of his men and a boy of his company<br />
that were a sleepe in their Cabins and they rose and came upon the deck to helpe to stay<br />
the ''Successe'' that if possible shee might have gone cleere of the ''dove'', before the<br />
''dove'' ranne upon her And to the rest of the<br />
Interrogatorie hee answereth negatively.
To the 4th and 5th Interrogatories hee saith hee was the first that espied the ''dove'' comming upon the ''Successe''<br />
and cryed out to her company in manner predeposed And saith the same being about 2<br />
a clock in the morning on the 8th of last August that the damage predeposed of was done the weather then [?was] darke but<br />
this deponent and his precontest Andrew Cristi and others of the Company did perfectly see<br />
the picture of an Angell in the head, and the picture of a dove<br />
in the sterne of the shipp which soe ranne upon the vessell ''Successe'' and sunke<br />
her, and saith the weather was something foggie but not then soe darke but it was possible to take notice<br />
of and know a shipp, it being soe neere as the ''dove'' then was And<br />
further saving his foregoeing deposition hee cannot answere saving hee saith hee<br />
was one of those which did espie the Angell and the dove upon the shipp ''dove'' at<br />
the tyme of the samage in question, and this deponent declared to his Company<br />
and others of this deponents company who alsoe sawe the same did declare to this deponent, before<br />
they came to Newcastle that the shipp that did the damage had an Angell on her<br />
head and a dove in her sterne and this deponent did declare the same to his precontest Andrew<br />
Cristi, and John Rowe and James hales./
To the 6th Interrogatorie hee saith hee never endeavoured to make any of the Company of the<br />
''dove'' drinke or tempte them with any money to make any confession to the effect Interrogated<br />
nor knoweth of any body else that soe did And otherwise saving his foregoeing deposition<br />
hee cannot answere./
To the 7th Interrogatorie hee saith hee never taxed any other Master of a shipp with doeing<br />
the damage in question save the sayd Cable, neither did this rendent say at any tyme<br />
that hee knew not what shipp or vessell did the same And further hee cannot<br />
answere./
