The clayme of Richard le Bas for the ''Dolphin''<br />

examined upon the said allegation.

of Stepney in the countie of Middlesex, Marriner<br />
aged 40 years or thereabouts a wittnesse sworne and<br />
examined saith and deposeth as followeth videlicet
To the first (and 2nd) Article of the said Allegation he saith and deposeth, That hee this<br />
deponent hath knowne the shipp the ''Dolphin'' alias the ''ffortune'' or ''hopewell?'' of<br />
Sunderland ever since about 5 or 6 yeares since, at which time shee belonged<br />
to the port of Sunderland, and was then under the Command of one Sampson<br />
Nicholson, who in or about the moneth of November 1653 last past<br />
sold and disposed of the said Vessell to the arlate Richard le Bas and<br />
Peter Knight Merchants living here in London, who constituted one Robbins<br />
to be Master and Commander of her for their use and accompt and so<br />
much the said Robbins did sewall times intimate say and declare to this<br />
Deponent both here at London and in ffrance, and that the Said Le Bas and Knight were<br />
the true and lawfull Owners of the Same or to that effect as also by the<br />
declaration of the Said Richard le Bas, who shortly after the buying<br />
of the Said Vessel desired this deponent to take the Care and Conduct of<br />
her upon him, which this deponent then refused as being then the provided of<br />
another Vessel, And saith That shortly after this deponent sailed in<br />
Command with the said Vessel (the Said Robbins Master) towards the Coast<br />
of ffrance, and afterwards saw her at Caen, the said Robbins then<br />
being dispossessed of her by order of her said Owner as was there<br />
generally reported the said Vessel then being under the Command<br />
of a fflemish Skipp, But what passed at Caen comprising the sale<br />
of ¾ parts of the said shipp, as is alleadged this deponent saith he doeth<br />
not know, nor is at all acquainted with any such transaction.<br />
And further hee cannot depose
To the third article and to the schedule our bill of sale annexed hee<br />
Saith hee knoweth nothing thereof otherwise or further than hee<br />
hath now predeposed
To the 4th hee Saith, hee this deponent hath knowne the arlate Richard le<br />
Bas for about 3 yeares last past, during which time the said<br />
le Bas hath lived in this City of this deponent knowledge and for sewall<br />
yeares before according to common report, and hath been and is<br />
esteemed a Merchant of this Citie and a subject of this Commonwealth<br />
and in that quality to pay all dues and dueties required of him, and saith<br />
the said le Bas did of this deponent observation fitt and furnish out the said<br />
shipp in Contoversie to sea upon the Voiage wherein shee went out after hee<br />
had first so bought her, which he knoweth for the reasons predeposed, and for<br />
that hee this deponent hath been for all that time well acquainted with the<br />
said Richard le Bas, and hath sewall times served him both in<br />
transporting goods from hence into ffrance, and from ffrance hitherence into ffrance, and from ffrance hither +
