Charles George Cock Esquire, one of the Judges if the<br />
high Court of the Admiraltie, saith and deposeth as<br />
followeth, videlicet.
That about tenn monthes since their issued out of this high Court<br />
a warrant at the sute of John Phillips against one Thomas<br />
hart of Dover for the arresting of the said Thomas hart, which was<br />
delivered to [BLANK IN MANUSCRIPT] Simpson Sergeant of the Admiraltie there to be<br />
executed; but the said Simpson in regard doctor Walker his hand was<br />
not set thereto, refused to execute it. Whereupon there was afterwards<br />
namely about three monethes since anthor warrant obtained from<br />
this Court at the sute and to the effect aforesaid, on the back whereof<br />
doctor Walker gave libertie for the exection thereof and set his hand<br />
therto, And the same was alsoe delivered to the said Simpson to bee<br />
executed, but the said Simpson keepeth the same in his<br />
hand and hath soe donne for theise two monethes last or<br />
thereabouts, and refuseth to execute and doth not execute<br />
the same although hee hath bin by this deponent and others [?XXX]<br />
thereunto, and although the said hart walketh frequently<br />
and publiquely abroad in dover, where the said Simpson [?XXX]<br />
many times have executed the said warrant, if hee would<br />
soe have donne.
