To the third he saith and deposeth that af … To the third he saith and deposeth that after the sayd thirteene barrs of sylver<br />
were laden aboard the ''Sampson'' as is arlate, videlicet in the moneth of September<br />
1652 the Purser of the sayd shipp the ''Sampson'' named Pedro da Campo<br />
signed three bills of lading for the same all of the same tenor, in<br />
which bills it was and is expressed that the sayd barrs were putt aboard<br />
the sayd shipp for the Accompt and adventure of the sayd Lewis<br />
ffernandez and to him and for his Accompt to be transported<br />
to and delivered att Ostend, this deponent being present att the signing<br />
of the sayd bills, and well remembing the effect thereof. And he<br />
further saith that one of the sayd three bills being the very bill to the sayd allegation was on board att the<br />
tyme of the seizure arlate and was in the custody and possession of the<br />
sayd Lewis ffernandez Angell att the tyme of the sayd seizure. And<br />
the sayd Bill of ladeing annexed [?to]<br />
the sayd allegation and now shewed him att the tyme of his examination<br />
was and is subscribed by the<br />
hand of the sayd Purser Pedro da Campo, and the contents of the sayd<br />
Bill were and are true, both for the markes of the severall parcells and weight of the<br />
severall barrs noted in the margent thereof and the body and contents<br />
of the Bill it selfe, this deponent being privy to the same and present<br />
at the signeing thereof as aforesayd. And otherwise he cannot depose.
To the fourth he deposeth and saith that the sayd shipp the ''Sampson''<br />
sett sayle and departed from Caddiz (sic) with the sayd sylver aboard her<br />
on or about the thirteenth day of October 1652 new stile, and about a moneth<br />
after in her direct Course to Ostend was taken and surprized in the<br />
English Channell by one of the shipps of this Commonwealth, and<br />
brought into the River of Thames as is arlate. And saith that<br />
the barrs of sylver arlate came by that meanes into the possession<br />
of them that tooke her, the sayd barrs of sylver allegat being then all of them aboard the<br />
shipp the ''Sampson'', which this deponent having continued constantly<br />
from the tyme of her departure from Caddiz to the tyme of her seizure<br />
is well assured of. And otherwise he cannot depose.
To the fifth he saith that the sayd Lewis ffernandez Angell was and is [?the]<br />
onely proprietor of the barrs of sylver arlate, and the same were really<br />
and truly laden for his Accompt, and not for the Accompt of any [?subiect]<br />
of the States of the united Provinces, the reason of which his knowledge<br />
he hath formerly sett forth. And otherwise cannot depose.
To the sixth he saith and deposeth that the arlate Lewis ffernandez [?Angell]<br />
was and is a Spaniard borne and a subiect of the King of Spayne [?and]<br />
hath bene an Inhabitant of Caracas in the West Indies under the Jurisdiction of the sayd king of [?Spayne]<br />
sixteene yeares now past as this deponent hath heard, and for eight<br />
last past of this deponents knowledge. And otherwise he cannot depose
To the seventh he saith and referreth himselfe to his depositions aforesayd<br />
